Johnson & Johnson Website Class Action Lawsuit Overview:

Johnson & Johnson fails to make its website fully accessible and independently usable for blind or visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Yensy Contreras claims Johnson & Johnson’s website neutrogena.com is not fully compatible with screen-reading software used by blind or visually impaired individuals to browse the internet.
Contreras wants to represent a nationwide class and New York subclass of blind or visually impaired consumers who have been “denied access to the equal enjoyment of goods and/or services” on Johnson & Johnson’s website over the past three years.
Contreras — a legally blind and visually impaired individual — says she attempted to make a purchase on neutrogena.com last month but was unable to complete her transaction due to accessibility issues.
Contreras claims her screen reader failed to read advertisement pop-up links and the “cart” link and describe website images and would skip over certain text on the page.
“The access barriers that Plaintiff encountered have caused a denial of Plaintiff’s full and equal access multiple times in the past, and now deter Plaintiff on a regular basis from accessing the Defendant’s website in the future,” the class action lawsuit states.
Plaintiff Claims J&J Intentionally Discriminated Against Blind or Visually IMpaired Individuals
Contreras further argues that Johnson & Johnson has intentionally discriminated against blind or visually impaired individuals by failing to construct a website that is fully accessible to them and by failing to take action to correct the issues.
“Defendant therefore uses standards, criteria or methods of administration that have the effect of discriminating or perpetuating the discrimination of others, as alleged herein,” the lawsuit states .
Contreras claims Johnson & Johnson is in violation of the Americans with Disabilities act of 1990 and the New York City Human Rights Law.
Contreras is demanding a jury trial and seeking preliminary and permanent injunction, along with other declaratory relief and statutory, actual and punitive damages for herself and all class members.
Multiple class action lawsuits were filed last month over claims of websites not being fully accessible for blind or visually impaired individuals, including against Honda, FanDuel and Warner Bros.
