The Utah Jazz Team Store website is not fully accessible to visually impaired and legally blind consumers, a new class action lawsuit alleges.
Plaintiff Yensy Contreras claims the Utah Jazz Team Store failed to design, construct, maintain, or operate its website in a way that it can be used with screen-reading software.
Contreras wants to represent a nationwide Class and New York subclass of visually blind or legally impaired consumers who have been denied equal access to the Utah Jazz Team Store website.
Utah Jazz Team Store Website Full of Access Barriers, Claims Class Action
Contreras, who is blind, says he uses a screen-reader while accessing websites on the internet, but encountered “multiple access barriers” while attempting to navigate the Utah Jazz Team Store website.
The barriers included, among other things, Contreras’ screen reader skipping over certain text, failing to read links, reading links in the incorrect order, and failing to read the “cart” link after a product is added, according to the class action lawsuit.
“These access barriers were the reason that Plaintiff was denied the full enjoyment of the goods and/or services offered on the website,” states the class action lawsuit.
Contreras claims the Utah Jazz Team Store is in violation of the Americans with Disabilities Act (ADA) and New York City Human Rights Law.
Contreras is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, statutory, and punitive damages for himself and all Class Members.
Class action lawsuits claiming the websites of popular companies are inaccessible to blind or visually impared customers have been mounting. Earlier this month, Evenflo joined more than 80 companies accused of violating the ADA, including Bic USA, L’Oreal, Sally’s Beauty Supply, American Eagle, and Gold’s Gym.
