Tripadvisor LLC fails to make its website fully accessible to blind or visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Yensy Contreras claims Tripadvisor’s website is not independently usable for individuals who use screen-reading software to browse the internet.
Contreras wants to represent a nationwide class and New York subclass of blind or visually impaired consumers who have been “denied access to the equal enjoyment of goods and/or services” on Tripadvisor’s website.
Contreras, who says she is blind, visually impaired,and handicapped, claims Tripadvisor’s website has multiple “access barriers” that keep her from being given “full and equal” access to it. Contreras claims that, while attempting to access Tripadvisor’s website, her screen reader failed to read item description links, skipped over certain text and failed to read certain banner links, among other things.
“The access barriers Plaintiff encountered have caused a denial of Plaintiff’s full and equal access in the past, and now deter Plaintiff on a regular basis from visiting the website, presently and in the future,” states the class action lawsuit.
Tripadvisor Aware of Access Barriers Yet Fails to Take Action, According to Class ACtion
Tripadvisor is aware of the access barriers its website presents to visually impaired individuals, Contreras argues, yet fails to “take actions to correct these access barriers in the face of substantial harm and discrimination to blind and visually-impaired consumers.”
Contreras claims Tripadvisor is in violation of the Americans with Disabilities Act of 1990 and the New York City Human Rights Law.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, statutory and punitive damages for herself and all class Members.
Contreras filed a similar class action lawsuit against Warner Bros. earlier this month over claims the company does not make its website fully accessible to blind or visually impaired individuals.
