Ole Smoky Distillery fails to make its website fully accessible and independently usable for legally blind or visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Joise Quezada claims Ole Smoky Distillery has failed to make its website compatible with screen-reading software used by blind and visually impaired individuals to access the internet.
Quezada wants to represent a nationwide Class and New York subclass of legally blind or visually impaired individuals who have been “denied access to the equal enjoyment of goods and/or services” offered on Ole Smoky Distillery’s website.
Quezada claims Ole Smoky Distillery’s website presents a number of accessibility issues for his screen reader, which he says is unable to describe images and read the “cart” link when a new item is added.
Ole Smoky Distillery’s Website Has ‘Access Barriers’ To Its Use
Further, Quezada’s screen reader skips over certain text on Ole Smoky Distillery’s website and reads banner links twice, according to the Ole Smoky Distillery class action.
Quezada claims the accessibility issues remain on Ole Smoky Distillery’s website to this day, presenting him purchasing certain goods and/or services.
“The access barriers that Plaintiff encountered have caused a denial of Plaintiff’s full and equal access multiple times in the past, and now deter Plaintiff on a regular basis from accessing the Defendant’s website in the future,” states the Ole Smoky Distillery class action.
Quezada claims Ole Smoky Distillery is in violation of the Americans with Disabilities Act and New York City Human Rights Law.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, statutory, and punitive damages for himself and all Class Members.
A number of class action lawsuits have been filed recently against companies accused of not making their websites fully accessible for blind or visually impaired individuals, including Barstool Sports, Dell, FanDuel, and Whole Foods, among others.
