Pernod Ricard website access class action lawsuit overview: 

  • Who: Jose Quezada filed a class action lawsuit against Pernod Ricard USA, LLC. 
  • Why: Quezada claims Pernod Ricard violates the law by failing to make its website fully accessible and independently usable for blind and visually impaired individuals. 
  • Where: The class action lawsuit was filed in New York federal court. 

Pernod Ricard USA fails to make its website fully accessible and independently usable for legally blind or visually impaired individuals, a new class action lawsuit alleges. 

Plaintiff Jose Quezada claims Pernod Ricard’s website is not compatible with screen-reading software used by blind and visually impaired individuals to browse the internet. 

He alleges Pernod Ricard’s website presented multiple accessibility issues for his screen reader, which he says was unable to read cookies pop-up links and the “cart” link when he added an item. 

Further, Pernod Ricard’s website requires the use of a cursor to close out a cookies pop-up, according to the Pernod Ricard class action. 

Pernod Ricard class action alleges website ‘access barriers’ remain

Quezada claims the accessibility issues remain to this day and continue to prevent him from being able to make a purchase from the website. 

“The access barriers Plaintiff encountered have caused a denial of Plaintiff’s full and equal access in the past, and now deter Plaintiff on a regular basis from visiting the website, presently and in the future,” the Pernod Ricard class action states. 

Quezada claims Pernod Ricard is in violation of the Americans with Disabilities Act and New York City Human Rights Law.

He wants to represent a nationwide class and New York subclass of legally blind or visually impaired individuals who have been “denied access to the equal enjoyment of goods and/or services” on Pernod Ricard’s website. 

Quezada demands a jury trial and requests declaratory and injunctive relief along with statutory, actual and punitive damages for himself and all class members. 

Consumers filed A number of similar complaints recently against companies including Whole Foods, Dell, HelloFresh and Mrs. Fields, among others, for not making their websites fully accessible to blind and visually impaired individuals.
