A class action lawsuit against Events and Adventures California and Adventures Northwest Inc. claims that the companies are wrongfully charging members a monthly fee, though all in-person events are currently canceled due to the coronavirus pandemic.

Plaintiff Ian Carisi explains that the two companies operate as one and run the singles club, “Events and Adventures.” Carisi says he is a current member of Events and Adventures and pays $170 per month to participate in activities through the organization, with the goal of meeting other singles.

However, Carisi says that since the middle of March 2020, no events have been available, due to the coronavirus pandemic. Despite this, the plaintiff states that he is still being billed and has not been refunded any part of his membership fee for March. He says that he inquired to the company and was told that he would also be billed for the month of April.

Carisi states that the organization charges these membership fees automatically and, during the coronavirus crisis, the organization has continued to use their access to withdraw fees. Because membership fees are around $170 per month and Events an Adventures has around 40,000 members around the country, the dating site event cancellation class action lawsuits asserts that Events and Adventures has succeeded in scamming customers out of around $6.8 million per month.

Despite making millions in fees, the company has allegedly failed to provide members with the services and “sole reason they signed up for membership.”

The COVID-19 event cancellation class action lawsuit notes that Events and Adventures’ practice of charging membership fees while not providing any events goes against the organization’s membership contract.

Allegedly, the contract says that Events and Adventures will make a minimum of 15 events per month available to members, if the member continues to pay monthly dues and remain eligible. However, the company allegedly did not provide any in-person events once “shelter in place” orders were issued.

The singles events cancellation class action lawsuit explains that the primary value that Events and Adventures claims to provide is, precisely, in-person events.

Allegedly, the organization aims to distinguish itself from other dating options by saying that with Events and Adventures allows singles to get out, meet people, and have exciting experiences, as opposed to staying home and scrolling through online dating sites.

Carisi cites Events and Adventures’ marketing language, noting that the organization advertises, “Don’t spend another weekend on the couch with Netflix or commenting on your friends’ social media posts…Make 2020 the year you get out, have fun, and maybe meet that special someone!”

Additionally, Carisi says that the organization features pictures of members enjoying social gatherings or spending time outside with one another, activities which are currently prohibited.

Events and Adventures have allegedly been cancelled due to coronavirus.The plaintiff says that he and other members were financially injured because had they known that they would not have access to the promised events, they would not have paid for their memberships, or would not have agreed to the terms of the membership.

He also stressed that users continue to suffer financial injury, as the problem is ongoing.

In filing a dating service event cancellation class action lawsuit, Carisi seeks to establish a Class of all those Events and Adventures members around the country who were charged membership fees during a period in which the organization did not provide any events, as well as a subclass of California customers who experienced the same.

Carisi stresses that a class action lawsuit is the appropriate way to challenge Events and Adventures’ current billing practices, because while the amount charged to each members is too small to warrant an individual lawsuit, the collective injury done to consumers, and total profits wrongly gained by the company, is significant.

He argues that the company violated the California Legal Remedies Act, the California Unfair Competition Law, and California’s False Advertising Law. He also asserts that the company breached express warranty and contract, negligently misrepresented its service, and committed fraud.

Carisi argues that the company was unjustly enriched from its billing practice, and says that the company should be required to return the funds it gained from wrongfully charging membership fees.

The plaintiff is represented by L. Timothy Fisher, Yeremey Krivoshey, and Scott A. Bursor of Bursor & Fisher PA.

    Happy to support – I have paid over $2000 for this and I’ve never even been to a single event. They claim to be a family run business but this is a MLM scheme scamming people out of their hard earned money even during the pandemic. Sign me up

    I tried to cancel after one month, I was told I couldn’t. Events and Adventure sent it to collections! How can they do that? The bill is 2 thousand dollars!! Please help!!!

    Yep trying to pay my bills. Don’t even have a job because businesses shut down so why does E&A get to charge money? Come on let’s get this thing going how do we join?
