Bank of the West TCPA Settlement Checks in the Mail
– Viewers of Top Class Actions are reporting they have received checks for more than $152 in the mail from the Bank of the West TCPA class action settlement. This settlement resolves allegations that Bank of the West illegally contacted consumers on their cell phones without their consent, in violation of the Telephone Consumer Protection Act. Congratulations to everyone who submitted valid claims and got PAID!

 

Bayer Hit with Xarelto Lawsuit Over Bleeding Complications – A Xarelto lawsuit filed against Bayer Corp., Janssen Pharmaceuticals and Johnson & Johnson alleges the blood thinner can cause dangerous, life-threatening complications. If you or a loved one took Xarelto (rivaroxaban) and suffered injuries such as uncontrollable internal bleeding, gastrointestinal bleeding, hemorrhaging, deep vein thrombosis or pulmonary embolism, you may have a legal claim.

 

CenturyLink Fiber Optic Cable Class Action Settlement Given Final Approval – A New Mexico federal judge has given final approval to a $4.8 million class action settlement, resolving claims that CenturyLink buried fiber-optic cables near or under landowners’ property without consent or compensation. This class action settlement is just one of dozens of agreements CenturyLink has finalized across the country to resolve similar claims.

 

Depakote Studies Confirm Link to Birth Defects – Recent studies have found that fetal exposure to Depakote increases the risk of having a child born with a birth defect by 12 percent, especially when the drug is taken during the first trimester. A growing number of plaintiffs are filing Depakote lawsuits alleging the manufacturers failed to warn pregnant women that the epilepsy medication could cause birth defects.

 

Kashi Agrees to $3.99M All Natural Class Action Settlement – Kashi Company, a division of Kellogg, has agreed to pay nearly $4 million to settle a class action lawsuit alleging it improperly applied all natural food labels to some of its products. If the settlement is approved, consumers who purchased Kashi GOLEAN Crunch! cereals or other Kashi foods with all natural labels may be entitled to a cash payment.

 

FDA Issues Warning About Invokana Ketoacidosis Link – Invokana (canagliflozin) was introduced by Johnson & Johnson and has rapidly grown to become a blockbuster treatment for type-2 diabetes. However, the U.S. Food and Drug Administration has announced that it is investigating reports that Invokana and other type-2 diabetes drugs may cause ketoacidosis. If you or a loved one suffered ketoacidosis, kidney failure or a heart attack after taking Invokana, Invokamet, Farxiga, Xigduo XR, Jaridance or Glyxambi, you may have a legal claim.

 

BMW Class Action Lawsuit Alleges Electrical Component Design Defect – BMW has been hit with a class action lawsuit alleging the car maker placed vital electrical components at the lowest part of the vehicle, making them susceptible to water damage. The plaintiff alleges this defect can cause a vehicle to shut down completely with very little warning. According to the class action lawsuit, BMW fraudulently concealed that the vehicles’ vital electrical equipment was located at the bottom of the trunk component and that water damage could cause an electrical failure.

 

Johnson & Johnson Settles Third Risperdal Bellwether Trial – The third in a series of Risperdal gynecomastia lawsuits slated for bellwether trials was recently settled, hours before it was scheduled to be heard in a Pennsylvania court. Johnson & Johnson and Janssen Pharmaceuticals are currently facing more than 1,300 similar Risperdal lawsuits. If you or your son took Risperdal between the ages of 10 and 18 and suffered male breast growth (gynecomastia), breast pain, nipple pain or nipple discharge, you may be eligible for compensation. Foam Cos. To Pay $128.5M to Settle Foam Antitrust Class Action – Carpenter & Co., Leggett & Platt Inc. and several other foam manufacturing companies have agreed to a class action settlement with indirect purchasers of polyurethane foam. This settlement will resolve allegations that the foam companies conspired to fix the prices of polyurethane foam products.

 

More Evidence of Propecia Sexual Dysfunction – A research team from Boston University found additional evidence that finasteride (sold under brand names Propecia and Proscar) may significantly increase the chances of sexual dysfunction even when compared to other enlarged prostate treatment drugs. If you or someone you love suffered sexual dysfunction after taking Propecia, Proscar or finasteride, you may have a legal claim.

Update from the President of TCA

 

Good morning fantastic Top Class Actions viewers! I hope you had a GREAT week! We just received the final notice plans for TWO new class action settlements we’ll be posting within the next week or so. It’s exciting to be included in official notification plans for class action settlements. We’re excited for a couple of reasons. First, we are able to post it IMMEDIATELY when the notice plan starts. That means you, our favorite viewer, get plenty of time to figure out if you qualify and submit a claim. Second, we actually get PAID to post it! Most of the settlements we write about we aren’t paid to post. We do so to help you so it’s great when we can actually cover the cost of writing up the Open Settlements article. I have to pay our writers, editors, researchers, IT team and my PR folks so every little bit helps!

On the home front we’re baking here in Phoenix. In fact, we had our first windstorm blow through on Saturday. It went from HOT (110 degrees), partly cloudy with no wind, to HOT and HOLY MOLY WE ARE GOING TO GET BLOWN AWAY WHAT THE HECK?!?!?! It took three of us in a scramble to secure the umbrellas around the pool. We actually almost lost one but with three of us wrestling it closed in the hot, gusting wind, we saved it. This time of year we get dust storm warnings every couple of days. It’s pretty crazy to go from a calm and hot day to seeing a huge wall of dust, hundreds of feet high, barreling towards you. When that happens we’ll even have a moment of calm sometimes where there’s no wind, but, it looks like it’s foggy outside. Unfortunately it’s not fog, it’s lung and nose clogging dust. Pretty eerie! OK, I’ve got to hop on a call with my PR team and then my youngest daughter Aubrey has been VERY patiently waiting for our daily dip into the pool. I better wrap up my work day or there will be a mini-revolution! On to more lawsuit and settlement updates!
