Life Time Fitness Inc. has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by sending text messages to cell phones without the express consent of the recipients. If you received a text message from Life Time Fitness between Jan. 1, 2014 through April 15, 2014, you may be eligible for benefits from the TCPA settlement.
The TCPA is a federal law that protects consumers from receiving unwanted text messages and phone calls. A company that is found in violation of the TCPA may be liable for damages of $500 per unlawful call or text, or up to $1,500 per message if the TCPA violation is found to be willful or knowing.
Life Time Fitness denies any wrongdoing but has agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty associated with litigation and a trial. According to the Life Time Fitness settlement notice, nearly 600,000 people may be eligible for benefits from the TCPA class action settlement. Under the terms of the class action settlement, the total payment by Life Time Fitness must be at least $10 million and no more than $15 million.
Who’s Eligible
Class Members of the Life Time Fitness TCPA settlement include anyone within the United States who received one or more text messages from Life Time Fitness to a cellular phone through the use of an online texting service between Jan. 1, 2014 and April 15, 2014.
Potential Award
Varies. Class Members may submit a claim for either a cash award of $100 or a membership award. Class Members who choose the membership award can select either a free 3-month single membership at a Life Time Gold club or a $250 credit toward any membership at any Life Time club.
The value of the award may be increased or decreased based on how many claims are submitted and which type of awards are selected.

The docket shows only one appeal filed, and the settlement was affirmed by the appeals court earlier this year. Unfortunately, no word on when claims will be paid.
TCA Had mentioned that the appeal was over back in March 2017…will this finally be paying out soon?
