A settlement has been reached in a Bank of America and Countrywide lien release class action lawsuit, resolving allegations brought forth against Countrywide Home Loans Inc. and Bank of America N.A. by plaintiffs who had a mortgage loan serviced by one or both of the named defendants in the state of Georgia.

The plaintiffs of this Countrywide and Bank of America lien release class action lawsuit allege that when these mortgage loan was paid in full, Countrywide and BofA failed to communicate a legal message of “satisfaction” or “cancellation” of lien (also known as a lien release) to the Georgia County clerk’s office within the time frame required by state laws.

Both Countrywide and BofA deny all liability in this lien release class action lawsuit, but have agreed to this BofA and Countrywide lien release class action settlement in order to avoid the uncertainty of future litigation as well as increasing court costs and attorneys’ fees. BofA and Countrywide have agreed to establish a $8.5 million lien release class action settlement fund to compensate eligible Class Members.

Who’s Eligible

You are a Class Member of this BofA and Countrywide lien release class action settlement if you owned the previously mortgaged property in the state of Georgia as of Feb. 12, 2007, or April 1, 2015, and Countrywide and/or Bank of America failed to transmit a satisfaction or cancellation of the lien on the property during the time frame required by Georgia law.

Potential Award

Up to $500.

Class Members who submit a valid and timely Claim Form will be eligible to receive up to $500 from the Bank of Ameria and Countrywide lien release class action settlement fund.

Proof of Purchase

If you are a Class Member of this Bank of America and Countrywide class action settlement, you should have received a Post Card Notice in the mail. If so, you should complete a Claim Form and provide the individual identification number found on this Post Card Notice.

If you cannot find this Post Card Notice or the individual identification number, then a proof of ownership of your property (such as a property bill) covered under the proposed settlement should be provided with the Claim Form. A complete Claim Form must be submitted online or mailed to the Claims administrator of this BofA and Countrywide lien release class action settlement postmarked no later than Aug. 24, 2015.

    I see some of you had the same problems with buying a house in Indiana and going from Pinnacle to Country Wide. This was our first time buying a home and we were completely bamboozled but not only Pinnacle but also our realtor. We lost everything behind their crap even our marriage. I hope they get it good for their BS

    We bought our home in 2000 in Indiana thru Countrywide and then BofA had bought the contract. We started having financial problems in 2003 and had to file a Chapter 13 and pay a state trustee our adjusted payback to BofA. At one point in around 2007 there was a $10,000 amount that the bank said they did not receive. After much research on our part and copies of all those payments made, we never were told where that money had went to. The bank would never refinance or lower our interest so we could keep the house and in 2011 we agreed to let the house go in Leiu of deed as they suggested and for 2 more years they still had no information that we agreed on this and had no paperwork on it. As of 2014 we still received calls from BofA to sign the house over with paperwork again and as of date we have horrible credit and it all began because they would not work with us on lowering interest or refinancing our loan. I would like to know why we never got this straightened out and told where the $10,000 went to.

    Countrywide got my mortgage from pinnacle then sold it to a private trust im in a foreclosure since 2009. Deudotshe bank say it got the mortgage from Pinnacle but it not Because de number was from countrywide ease help

    Has anyone received a check yet ? The administrator informed me that checks were mailed in October !!! I own a home in Atlanta with BofA !!!

    I lost my home with BOA because they failed to give us any assistance when we fell behind on our mortgage. Now I cant buy a home because my credit was ruined. Thanks Bank Of America, for ruining my life and my future!!!…

    I was sent the postcard about this settlement last summer (2014). I filled it out, sent it in before the due date and still have heard nothing further about it. I do not live in Georgia. Has anyone outside of GA that did file, hear anything back yet?

    I bought my home and land together in 2003 paid it off in 2007. I have yet to get the deed to my land or the total to my manufactured home. What should I do?

    What if this happened to us in another state? This happened to us in 2008 in MA. They NEVER recorded the release of mortgage – costing us time, $$, aggravation and making our closing attorney VERY ANGRY. We almost lost our sale b/c of their lax attitude in handling the transfer of a mortgage to another company. To date, the land records have STILL not been fixed.
