3 Ballerina Tea Lawsuit

Truong Giang Corp. (TGC) has agreed to settle a class action lawsuit alleging it made false and misleading statements in regard to some of its products. If you purchased certain TGC products between March 27, 2010 and March 30, 2015, your rights may be affected by the class action settlement.

The class action lawsuit alleges Truong Giang Corp. made false and misleading claims regarding the safety and health benefits of the following products:

  • 3 Ballerina Tea Dieter’s Drink Extra Strength
  • 3 or Three Queen’s Ladies Tea (Regular and Extra Strength)
  • Herbal Tea (including Ginseng Flavor, Lemon Flavor, Cinnamon Flavor, and Orange Flavor – Regular and Extra Strength)
  • Two Ladies Dancing with Tree Tea (Regular and Extra Strength)
  • Double Sailing Ship Tea
  • Special Tea
  • Three Star Brand Special Tea
  • Two Beauties (Three Stars) Herbal Tea
  • American Ginseng Tea
  • Tu Chung Tea
  • 3 Ballerina Herbal Slim Capsules

According to the class action lawsuit, TGC marketed these products as having the ability to help with weight loss, encourage long-lasting weight loss, and that they were safe to consume year round. Further, the plaintiffs took issue with the lack of label on the products indicating that the statements had not been evaluated by the U.S. Food and Drug Administration. The plaintiffs asserted claims under California’s Consumer Legal Remedies Act, Unfair Competition Law, False Advertising Law, and breach of express and implied warranties.

Truong Giang Corp. denies the allegations but agreed to settle the false advertising class action lawsuit to avoid the uncertainty, burden and expense of ongoing litigation. Under the terms of the class action settlement, TGC must change the labeling and advertising of the products at issue within 12 months after the date the settlement receives final approval.

Who’s Eligible

Class Members of the TGC settlement include all U.S. consumers who purchased certain TGC products for household or personal use between March 17, 2010 and March 30, 2015. The products covered by the class action settlement include:

  • 3 Ballerina Tea Dieter’s Drink Extra Strength
  • 3 or Three Queen’s Ladies Tea (Regular and Extra Strength)
  • Herbal Tea (including Ginseng Flavor, Lemon Flavor, Cinnamon Flavor, and Orange Flavor – Regular and Extra Strength)
  • Two Ladies Dancing with Tree Tea (Regular and Extra Strength)
  • Double Sailing Ship Tea
  • Special Tea
  • Three Star Brand Special Tea
  • Two Beauties (Three Stars) Herbal Tea
  • American Ginseng Tea
  • Tu Chung Tea
  • 3 Ballerina Herbal Slim Capsules
Potential Award

The TGC settlement does not provide cash benefits to Class Members, but it does provide significant injunctive relief. Under the terms of the false advertising class action settlement, Truong Giang Corp. has agreed to add the following disclaimer to its products’ packaging and product-specific webpages: “These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”

In addition, TGC will remove the allegedly misleading labeling at issue in the class action lawsuit, including statements indicating the products can help users lose weight, are effective for long-lasting weight loss, and are safe to drink year round.

Claim Form Deadline

N/A. The TGC class action settlement only provides injunctive relief. Therefore, no Claim Form is required for Class Members to benefit from the deal.

Class Members who wish to object to or exclude themselves from the class action settlement must do so no later than July 6, 2015.

    My wife drank this tea and was diagnosed with liver disease. My wife passed away march 26th 2014. She was diagnosed with non alcoholic cirrhosis.

    Now what about all the money we have put in the product before they were forced to remove and correct the label

    They should have to reimburse people who bought this product. We wasted our money thing it did what they advertised, instead they only have to change their label? They got off easy, and I don’t get my money back
