Bank of the WestConsumers who allegedly received unsolicited phone calls from Bank of the West are now receiving checks in the mail from the Bank of the West Settlement Fund.

TCA viewers on Facebookare reporting that valid claims have been paid out and Class Members are receiving checks for as much as $152.15 from the Bank of the West TCPA class action settlement.

This TCPA class action settlement stems from the Bank of the West TCPA class action lawsuit known as Bayat v. Bank of the West, which alleges the bank illegally contacted consumers on their cellphones without their express consent, a violation of the Telephone Consumer Protection Act (TCPA). The Bank of the West class action lawsuit also claims the bank used an automatic telephone dialing system and/or prerecorded voice messages to contact plaintiffs and Class Members over supposed accrued debts, another alleged TCPA violation.

However, back in June 6, 2014, Bank of the West agreed to a $3.35 million TCPA class action settlement to resolve the TCPA claims against the bank. Bank of the West denies all wrongdoing and liability in this TCPA class action lawsuit, but has decided to settle in order to avoid further court costs and the uncertainty of continued litigation.

Additionally, as part of the Bank of the West TCPA settlement, Class Members also have the option to submit what is known as a revocation request, which will prevent the bank from placing certain types of cell phone calls in the future.

U.S. District Judge Edward M. Chen gave this Bank of the West settlement preliminary approval in July of last year. In January 2015, the TCPA class action settlement was given final approval, and now Class Members are receiving their share of the settlement fund.

You are a Class Member of the Bank of the West TCPA class action settlement if you live in the United States and received a non-emergency cell phone call by Bank of the West or by a third-party group on behalf of the bank between Nov. 2, 2008, and July 22, 2014. The deadline to submit a claim for the Bank of the West settlement passed on Dec. 4, 2014.

Per the terms of the Bank of West TCPA Class Action Settlement, a typical award for this settlement was expected to be about $25 to $50 for each valid Claim form submitted by each eligible Class Member. This means that a Class Member’s award may be higher if they received multiple calls from Bank of the West and submitted the appropriate forms to the Claims Administrator of this Bank of the West settlement. However, the actual award for each individual may be more or less depending on the number of Claim Forms filed.
