Ark. Woman Claims Biomet Hip Implant is Defective – An Arkansas woman and her husband claim that Biomet failed to adequately warn consumers about the risks and severity of side effects associated with the Biomet M2a Magnum hip replacement system. According to the hip implant lawsuit, the woman suffered debilitating pain and discomfort and had to undergo premature hip revision surgery to replace the metal hip implant. If you or a loved one had a metal-on-metal hip implant that failed or caused serious complications, you may be able to take legal action against the manufacturer.
Judge Gives Final OK to Herbalife Class Action Settlement – A California federal judge has granted final approval to a class action settlement over allegations Herbalife International of America Inc. operates as an illegal pyramid scheme. The Herbalife class action settlement will compensate individuals who joined Herbalife as primarily a business opportunity and lost money while pursuing the opportunity. The settlement also allows Herbalife distributors who return unused products to file a claim for compensation.
Diabetes Medication Actos Linked to Heart Attacks – A recent study shows patients taking the type-2 diabetes medication Actos may have a greater risk of suffering heart failure. Actos has also been linked to bladder cancer in patients who took the drug for more than a year. Settlement Reached in ExamSoft Program Glitch Class Action Lawsuit – A settlement has been reached in a class action lawsuit accusing ExamSoft Worldwide Inc. of glitches in its programming that prevented bar exam takers from uploading their answers, allegedly causing a “Bar Exam Disaster.” If the ExamSoft settlement is approved, eligible Class Members may be able to make a claim for a cash payment of $90.
Depakote Lawsuit Claims the Drug Caused Birth Defects – A recent Depakote lawsuit alleges the drug manufacturers failed to warn pregnant consumers that the anti-seizure medication may increase the risk of birth defects by 25 percent. The plaintiff claims that she took Depakote during her pregnancy and that her child was born with physical, cognitive and behavioral abnormalities. Emeritus Settles Class Action over Assisted Living Staffing Levels – A settlement has been reached in a class action lawsuit alleging Emeritus Corporation and its successor company Brookdale Senior Living Inc. misinformed residents at more than 70 assisted living facilities that its staffing levels and charges were determined by “state of the art” assessments, even though they actually based their staffing decisions on profit goals and labor budgets. Under the terms of the class action settlement, eligible Class Members are expected to receive cash payments worth an average of $450 each!
Xarelto Linked to Uncontrolled Bleeding – A new Xarelto lawsuit alleges Janssen Research and Development manufactured a defective and dangerous drug that caused a woman to suffer adverse side effects. The plaintiff alleges the defendant negligently or fraudulently hid defects associated with the anticoagulant from the medical community and general public. If you or a loved one took Xarelto and suffered injuries such as uncontrollable internal bleeding, gastrointestinal bleeding, hemorrhaging, deep vein thrombosis or pulmonary embolism, you may have a legal claim.

Update from the President of TCA
Good morning everyone! Hopefully you’re reading this update, and clicking on links, through the NEW website host. Fingers crossed we don’t have any issues. We tried working things out with our old host but they simply couldn’t keep up with YOU! We’re now hosted on two different servers, with additional services in place to help make sure we don’t have any more site issues. I’m working directly with the CEO of our new host and he’s assured me they can handle anything we throw at them so I’m hopeful we’ll be AWESOME!
On the home front, I just got back from my annual guys’ trip to Puerto Penasco, Mexico. I’m happy to report that there were no injuries, no problems, but lots of fun was had. Deep sea fishing, jet skiing, a little golf and of course a lot of time in the water. It was FANTASTIC! There was a large police presence in Sonoita (the border town on the way to Puerto Penasco), but we didn’t get hassled and had a smooth trip down south and back. Now I’m going to play with my girls! I missed them and they missed their nightly piggyback rides to bed. Time to have fun! More lawsuit and settlement updates are below.
