MetLife class action lawsuit

A class action settlement has been reached with Metropolitan Property and Casualty Insurance Co., also known as MetLife Auto and Home, over allegations that MetLife miscalculated the depreciation of properties resulting in lower payouts for home repairs. If you had a homeowners insurance policy through MetLife from 2006 through 2013 in Arkansas, in which MetLife paid for a home repair, you may qualify for this class action settlement.

The MetLife class action lawsuit was filed in December 2013 by plaintiff Gary Vinson in an Arkansas state court, alleging that when he enlisted the insurance company to cover the repair costs on damage to his property that MetLife did not depreciate the material and labor costs for the repairs properly. While the damage totaled $4,984.67, MetLife sent him a check for $1,473.32, after subtracting the $1,000 deductible.

This class action settlement is for MetLife policy holders in Arkansas who filed a claim for physical damage to a property insured by MetLife from Jan. 1, 2006 through Dec. 31, 2013, and MetLife made an payment, that included a deduction for the estimated depreciation of the property.

There are a range of payments that Class Members will receive depending on several variables such as “the amount of the estimated non-material depreciation that was deducted from the claim, the amount of estimated non-material depreciation that was recovered, whether repair or replacement of the damaged property was completed and the date of loss.”

MetLife denies the allegations in this class action lawsuit but agreed to the class action settlement to avoid the cost and risk of a trial. The MetLife homeowners insurance class action settlement was preliminarily approved by an Arkansas state judge on Dec. 12, 2014. The final approval occurred on April 20.

Who’s Eligible

The Class includes persons who filed a first party insurance claim for physical damage from Jan. 1, 2006 through Dec. 31, 2013 on an Arkansas homeowners insurance policy (including home, mobile or manufactured home, condominium, farm/ranch or rental dwelling), issued by MetLife or one of its Affiliates, that resulted in an indemnity payment by MetLife or one of its Affiliates under Coverage A or B, where the claim was paid at less than the limit of liability (accounting for deductible), and where MetLife or one of its Affiliates made an indemnification payment that included a deduction for estimated depreciation of non- material.

Potential Award

The award depends on a variety of factors such as “the amount of the estimated non-material depreciation that was deducted from the claim, the amount of estimated non-material depreciation that was recovered, whether repair or replacement of the damaged property was completed and the date of loss.”

Proof of Purchase

You must be able to provide the policy number, claim number and approximate date of loss, in addition to other information explained on the claim form.
