A new class action lawsuit alleges Keurig Dr Pepper falsely advertises its Snapple beverages as “all natural” when they actually contain synthetic citric acid.
Plaintiff Kesha Peters filed the class action complaint against Keurig Dr Pepper in New York federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Snapple beverages are falsely labeled as “all natural” to capitalize on consumer preferences for natural foods. The complaint alleges that the drinks contain synthetic citric acid, which is used as a flavor enhancer and preservative.
Peters says she purchased Snapple Peach Tea at a C-Town supermarket in Brooklyn, New York, for $1.49, relying on the “all natural” label. She claims she would not have bought the product had she known it contained synthetic ingredients.
Snapple class action lawsuit argues ‘all natural’ label misleading
The lawsuit argues that the “all natural” label misleads consumers into believing the product is healthier and safer, which allows the company to charge a premium price.
The complaint also alleges that the Food and Drug Administration (FDA) considers citric acid to be synthetic. It cites FDA warning letters to other companies, stating that products containing citric acid should not be labeled as “all natural.”
Peters is looking to represent anyone in the United States who purchased Snapple beverages labeled as “all natural” for personal use. She is suing for violations of New York General Business Law and breach of express warranty. The lawsuit seeks class certification, damages, restitution and injunctive relief.
Earlier this year, The J.M. Smucker Co. faced a class action lawsuit alleging it falsely advertised its fruit spreads as “natural” and “made with ingredients from natural sources,” when they contained synthetic citric acid.
