The Comenity Bank lawsuit centers on allegations that Comenity Capital Bank used prerecorded calls and voicemails to contact consumers without the consent required by federal law. 

These claims argue that:

  • Consumers allegedly received prerecorded calls and voicemails without first providing the consent required by federal law.
  • The prerecorded messages referenced “tax services,” “tax refund,” “tax season,” “tax resolution and relief” or a “special resolution unit.”
  • Some calls were allegedly made to people who never had a Comenity Capital Bank, Bread Financial or store-branded credit card account.
  • Some consumers reportedly continued receiving calls even after closing their accounts or asking the calls to stop.

If these allegations are proven, affected consumers may be eligible to recover statutory damages of $500 to $1,500 for each unlawful call under the TCPA.

  • You received one or more prerecorded calls or voicemails from Comenity Capital Bank.

  • Written consent is generally required for prerecorded telemarketing calls.
  • Consumers may be able to recover $500 per unlawful call, or up to $1,500 per call if the violation was willful or knowing.
  • These rules apply to banks and credit card issuers, just like they do to other businesses.

Consumers who received these calls may be able to pursue compensation through a TCPA lawsuit.
