Judge Axes Florida’s Natural Orange Juice Class Action Lawsuit

An Alabama judge on Tuesday tossed a class action lawsuit accusing Citrus World Inc. of mislabeling its Florida’s Natural products as “100% orange juice” even though the product is “heavily processed, stored and flavored” before reaching store shelves.
The claims are nearly identical to those made in three separate class action lawsuits alleging Tropicana orange juice and Simply Orange juice aren’t 100% pure and natural as advertised.
U.S. District Judge Inge Prytz Johnson ruled that plaintiff John Veal Jr. did not sufficiently prove he was injured by purchasing Florida’s Natural juice, which he claims would not only be unappealing, but nearly “undrinkable” if it was not heavily processed and flavored.
Judge Johnson had harsh words for Veal, saying, “The plaintiff makes much ado about believing the packaged containers of orange juice contained ‘fresh squeezed’ orange juice. As a matter of common sense, whatever is in a container on a store shelf with an expiration date some weeks hence cannot contain ‘fresh’ anything.”
“The fact that the plaintiff may have believed defendant hired individuals to hand squeeze fresh oranges one by one into juice cartons, then boxed up and delivered the same all over the country does not translate into a concrete injury to plaintiff upon his learning that beliefs about commercially grown and produced orange juice were incorrect,” Judge Johnson added before denying Veal’s motion to file a third amended complaint.
The Florida’s Natural Orange Juice Class Action Lawsuit case is Veal v. Citrus World Inc., Case No. 12-cv-00801 in the U.S. District Court for the Northern District of Alabama.
