UPDATE: A federal judge dismissed the Frozen Pizza Trans Fat Class Action Lawsuit on October 1.
A California woman has filed a $5 million class action lawsuit against California Pizza Kitchen and Nestle, owner of the brands Stouffer’s and DiGiorno, claiming the companies are “deliberately poisoning their consumers” by selling frozen pizzas that contain partially hydrogenated vegetable oil, an artificial trans fat that’s a “toxic carcinogen.”
Plaintiff Katie Simpson alleges in the frozen pizza class action lawsuit that there are safe, low-cost and commercially acceptable alternatives to trans fat, but that the defendants “unfairly elect not to use those substitutes… in order to increase profit at the expense of consumer health.”
Trans fat has been known to cause or contribute to heart disease, type-2 diabetes, Alzheimer’s disease, breast cancer, colon cancer, and more, according to the class action lawsuit.
Trans fat has been used extensively in many processed foods, but in recent years scientists have determined that the additive is unhealthy. A number of countries, including Denmark, Austria, Switzerland, Brazil, Argentina, Chile and South Africa, have banned trans fat or limited its use.
California, New York City and several other U.S. cities have banned artificial trans fat from restaurants.
“Now, given its toxic properties few food companies continue to use [partially hydrogenated vegetable oil]. Defendants, however, have decided not to follow their more responsible peers and cease using PHVO, instead placing profits over public health and deliberately poisoning their consumers,” the frozen pizza class action lawsuit states.
Simpson is seeking restitution, disgorgement of profits, corrective advertising and more.
The Frozen Pizza Trans Fat Class Action Lawsuit case is Simpson v. California Pizza Kitchen Inc. and Nestle USA Inc., Case No. 12-cv-164, California Southern District Court, San Diego.
