UPDATE: A federal judge dismissed the Frozen Pizza Trans Fat Class Action Lawsuit on October 1.
A California woman has filed a $5 million class action lawsuit against California Pizza Kitchen and Nestle, owner of the brands Stouffer’s and DiGiorno, claiming the companies are “deliberately poisoning their consumers” by selling frozen pizzas that contain partially hydrogenated vegetable oil, an artificial trans fat that’s a “toxic carcinogen.”
Plaintiff Katie Simpson alleges in the frozen pizza class action lawsuit that there are safe, low-cost and commercially acceptable alternatives to trans fat, but that the defendants “unfairly elect not to use those substitutes… in order to increase profit at the expense of consumer health.”
Trans fat has been known to cause or contribute to heart disease, type-2 diabetes, Alzheimer’s disease, breast cancer, colon cancer, and more, according to the class action lawsuit.
Trans fat has been used extensively in many processed foods, but in recent years scientists have determined that the additive is unhealthy. A number of countries, including Denmark, Austria, Switzerland, Brazil, Argentina, Chile and South Africa, have banned trans fat or limited its use.
California, New York City and several other U.S. cities have banned artificial trans fat from restaurants.
“Now, given its toxic properties few food companies continue to use [partially hydrogenated vegetable oil]. Defendants, however, have decided not to follow their more responsible peers and cease using PHVO, instead placing profits over public health and deliberately poisoning their consumers,” the frozen pizza class action lawsuit states.
Simpson is seeking restitution, disgorgement of profits, corrective advertising and more.
The Frozen Pizza Trans Fat Class Action Lawsuit case is Simpson v. California Pizza Kitchen Inc. and Nestle USA Inc., Case No. 12-cv-164, California Southern District Court, San Diego.

We eat these pizzas all the time,if we knew they contained that we would have stopped buying them
What isn’t bad for you anymore. Too much water, too many vitamins, too much jogging. This is just another way for someone to get rich. All the companies should become LLC’s and unless they are truly harmful, would they be able to be sued.
I am not surprised! Its Frozen pizza! Its time to start making your own pizza at home America! Its sad that these companies can get away with poisoning us. The FDA and Conagra allows it! I think who is going after the companies should go after the FDA for allowing it as well.
darn and they were on sale too…
I had no idea that those pizza had harmful trans fats in them.
Ugh, don’t play the victim — the ingredients are listed on the back! The nutrition label shows that there is trans fat in the some of the pizzas. You are WILLINGLY being “slowly poisoned” since they state that these pizzas contain trans fats. I don’t get why anyone is surprised by this. Everyone should be reading the labels of the foods you’re putting into your bodies. It’s like complaining that there’s too much sodium in something — if you don’t like it, don’t buy/eat it. It’s not rocket science. This case isn’t going anywhere…
Terry – that is right we must think of the grandkid too…
Wow! We thought we were buying the best of the frozen pizza’s. We have been slowly poisoned.
My whole family/grandkids always eats these pizzas and it,s heartbreaking to know that its harmful to our health.
We had no idea that the Pizza’s had the trans fat oils. What a bummer.
