UPDATE: A federal judge dismissed the Frozen Pizza Trans Fat Class Action Lawsuit on October 1.
A California woman has filed a $5 million class action lawsuit against California Pizza Kitchen and Nestle, owner of the brands Stouffer’s and DiGiorno, claiming the companies are “deliberately poisoning their consumers” by selling frozen pizzas that contain partially hydrogenated vegetable oil, an artificial trans fat that’s a “toxic carcinogen.”
Plaintiff Katie Simpson alleges in the frozen pizza class action lawsuit that there are safe, low-cost and commercially acceptable alternatives to trans fat, but that the defendants “unfairly elect not to use those substitutes… in order to increase profit at the expense of consumer health.”
Trans fat has been known to cause or contribute to heart disease, type-2 diabetes, Alzheimer’s disease, breast cancer, colon cancer, and more, according to the class action lawsuit.
Trans fat has been used extensively in many processed foods, but in recent years scientists have determined that the additive is unhealthy. A number of countries, including Denmark, Austria, Switzerland, Brazil, Argentina, Chile and South Africa, have banned trans fat or limited its use.
California, New York City and several other U.S. cities have banned artificial trans fat from restaurants.
“Now, given its toxic properties few food companies continue to use [partially hydrogenated vegetable oil]. Defendants, however, have decided not to follow their more responsible peers and cease using PHVO, instead placing profits over public health and deliberately poisoning their consumers,” the frozen pizza class action lawsuit states.
Simpson is seeking restitution, disgorgement of profits, corrective advertising and more.
The Frozen Pizza Trans Fat Class Action Lawsuit case is Simpson v. California Pizza Kitchen Inc. and Nestle USA Inc., Case No. 12-cv-164, California Southern District Court, San Diego.

ive been buying this pizza for years as well as red baron i wont feed this to my family anymore where do i sign up at!!!!!!!!
Ooops… lol …plants,
Another fantastic reason to eat a plant based diet!!!!
Read all food labels that come into your home… Before you buy!!
I hope nestle loses its trans fat as_ on this one. Buyer beware that many more food companies are in cahoots with government agencies so that our food is purposefully unhealthy…. Disease and sickness are the only things that drive our economy, not health and well being. Phamacuetical companies also make a bundle on our demise.
Eat more organic non- gmo pants,
fat lazy frozen pizza eaters aren’t expected to know how to spell.
You really can’t believe anything. And unless you’re growing your own food, you have no idea what you’re consuming. I hate the thought of what I fed to my children when they were growing up and wasn’t aware of the ramifications. How do we join the law suit?
DI GIORNIO HAS ALWAYS BEEN MY FAVORITE AT HOME PIZZA FOR MY DAUGHTER AND I. NO MORE!!!

My son and I enjoy DiGiorno all the time and had NO idea about the transfats. So disappointed.
We listen to commercials and allow our family’s to do the same and be influenced by them, we come to believe that the pizzas in the commercials have some sense of health intake for us, now we find that its not true…what is the side effect we have to look forward to now ? what price for all of the pizza our family has eaten ?
