Mirena IUD lawsuitA Mirena lawsuit has been filed against Bayer Healthcare Pharmaceuticals Inc. claiming a Colorado woman suffered Mirena complications resulting in painful, and possibly permanent, injuries caused by the IUD.

Plaintiff Brittany D., 22, was prescribed the Mirena IUD birth control device in March 2010. At that time, a physician inserted the intrauterine device into Brittany’s uterus in order to prevent unwanted pregnancies, and the attending physician checked to ensure that the Mirena placement was correct and posed no danger to the plaintiff’s health, the Mirena lawsuit says.

However, in November 2013, Brittany underwent a CT scan, which reportedly revealed the Mirena IUD had migrated from its original placement, perforated her uterus, and eventually became lodged in her left ovary.

Brittany alleges she “underwent a laparoscopic removal of her Mirena on or about January 30, 2014, where Plaintiff’s Mirena was found to be in the peritoneal cavity. Plaintiff also experienced an unplanned pregnancy,” states the Mirena IUD lawsuit.

Because of the Mirena side effects, Brittany still allegedly suffers permanent bodily impairments, diminished enjoyment of her life, and mental anguish.

Brittany brings several allegations against Bayer, including claims of defective manufacturing, design defect, negligence, failure to warn, strict liability, breach of implied warranty, breach of express warranty, negligent misrepresentation, fraudulent misrepresentation, fraud by concealment, and violation of several states consumer protection acts.

The Mirena Lawsuit is Case No. 0:15-cv-01208-PAM-HB, in the U.S. District Court for the District of Minnesota.

Mirena IUD Complications

Mirena is a t-shaped plastic birth control device manufactured by Bayer. The IUD is meant to be implanted in a woman’s uterus where it then releases synthetic hormones like progestin and leveonorgestrel into a woman’s bloodstream, which will “thicken cervical mucus, thin the uterine lining, inhibit sperm movement and reduce sperm survival to prevent pregnancy,” according to product packaging.

However, according to news reports, hundreds, if not thousands, of incidences of Mirena IUD migration have been documented. That’s when the IUD moves from the original implantation site and embeds itself in the uterine wall.

Despite these reports of Mirena complications and FDA warnings, Bayer has continued to manufacture and sell Mirena to women looking for an effective, long-term form of birth control.
