Mirena IUD lawsuitA Mirena IUD lawsuit has been filed against Bayer Healthcare Pharmaceuticals Inc. by a California resident alleging she suffered injuries because of the birth control device. This is just one of hundreds of Mirena lawsuits filed in federal court over the last couple years.

Plaintiff Misty M. was allegedly implanted with the Mirena IUD in November 2010 and had a follow-up examination at which time it was determined that the Mirena device had been properly placed during the insertion procedure, she explains in her Mirena IUD lawsuit. 

However, on June 21, 2012, just a couple years after the initial insertion of the Mirena intrauterine device, Misty claims she experienced pain in her left abdomen — pain so severe that she went to the emergency room.

According to the Mirena IUD lawsuit, “on June 23, 2012, [the Plaintiff] returned to Riverside Community Hospital in Riverside, California for follow-up with complaints of continued left lower abdominal pain and vaginal bleeding. On this date an ultrasound was performed which showed an ectopic pregnancy. The ultrasound also showed that the Mirena IUD had migrated to the lower uterus near the cervix.”

Because of the alleged migration of the Mirena IUD, Misty was required to undergo laparoscopy to surgery to remove the birth control device and the ectopic pregnancy. As a result of the pain and suffering experienced by Misty because of the intrauterine contraceptive device’s migration, she decided to file this Mirena IUD lawsuit.

Misty  is bringing several allegations against Bayer in the Mirena lawsuit, including claims of defective manufacturing, defective design, failure to warn, negligence, breach of implied warranty, breach of express warranty, negligent misrepresentation, fraudulent misrepresentation, and fraud by concealment.

Misty is seeking relief in the form of compensatory, statutory and punitive damages as well as payment of attorney’s fees by Bayer.

The Mirena IUD Lawsuit is Misty M. v. Bayer Healthcare Pharmaceuticals Inc., Case No. 7:14-cv-08087-CS, in the U.S. District Court for the Central District of California.

Mirena Side Effects

The Mirena IUD is a t-shaped plastic birth control device that releases progestin and levonorgestrel (synthetic hormones) into a woman’s bloodstream in order to “thicken cervical mucus, thin the uterine lining, inhibit sperm movement and reduce sperm survival to prevent pregnancy,” according to Bayer’s product packaging.

The Mirena IUD is designed in such a way that it can be implanted into a woman’s uterus within seven days of menstruation and remain implanted for up to five years.

However, according to the hundreds of Mirena IUD lawsuits, many women have allegedly experienced uterine perforation anywhere from two months to two years within initial implantation of the intrauterine device. The subsequent damage necessitated emergency surgery and early removal of the Bayer birth control product.

According to news reports and Mirena lawsuits, Bayer did not immediately update the intrauterine contraceptive product packaging despite the hundreds of reported incidents of uterine lining embedment and perforation due to the Mirena IUD’s alleged migration. Despite these reports and additional warnings by the Food and Drug Administration (FDA), Bayer has continued to manufacture, and sell Mirena IUD.

Some Mirena IUD side effects alleged in the product liability lawsuits and reported to the FDA include:

  • Breast pain/tenderness
  • Inter alia
  • Perforation
  • Migration
  • Ectopic/intrauterine pregnancy
  • Cancer
  • Adhesions
  • Cysts
  • Fetal injury/death
  • Early/premature menopause

There are about 1,042 Mirena IUD lawsuits pending in federal court. The number Mirena IUD lawsuits is expected to grow as more women file Mirena IUD lawsuits or join Mirena IUD class action lawsuits through the remainder of the year.
