2009 Honda CivicA federal class action lawsuit claims the front brake pads in 2008-2010 Honda Civics wear out prematurely, often in less than 15,000 miles, yet Honda won’t repair them under warranty.

According to the Honda Civic brake pad class action lawsuit, “The braking system installed in the 2008, 2009 and 2010 Model Year Honda Civic Vehicles (‘Class Vehicles’) suffers from one or more design and/or manufacturing defects that causes the Class Vehicles’ front brake pads to wear out prematurely, and require replacement approximately every 7,500 to 15,000 miles, far more frequently than in a properly functioning braking system. Although defects in material, manufacturing and workmanship are covered by Honda’s New Vehicle Limited Warranty, Honda has failed to repair the Brake Defect under warranty.”

The Civic brake pad class action lawsuit goes on to say that Honda knows about the Brake Defect and knows that consumers do not anticipate having to inspect or replace their Civic’s front brake pads every 7,500 to 15,000 miles, yet Honda continues to not inform current owners and lessees about the Civic Brake Defect, and has not disclosed the Brake Defect to purchasers and lessors of 2008-2010 Civics.

This not only poses a safety hazard to consumers, but also forces them to pay hundreds, if not thousands, of dollars to prematurely replace the brake pads, rotors, calipers and other brake related components as a result of the Civic Brake Defect, the Honda Civic class action lawsuit states.

“Honda knew and concealed the Brake Defect that is contained in every Class Vehicles, along with the attendant dangerous safety problems and associated repair costs, from Plaintiffs and Class Members both at the time of sale and repair and thereafter,” the class action lawsuit states. “Had Plaintiffs and Class Members known about these defects at the time of sale or lease, [they] would not have purchased the Class Vehicle or would have paid less for them.”

The Honda Civic class action lawsuit is brought on behalf of all current and former owners or lessees of a 2008, 2009 or 2010 Model Year Honda Civic vehicle. It is seeking class certification, damages and restitution for Class Members for violations of the California Consumer Legal Remedies Act, violations of the Unfair Business Practices Act, and breach of warranty under the Song-Beverly Consumer Warranty Act and the Magnuson-Moss Warranty Act.

    I haven’t had Honda civic hybrid but five months got it from.Forest city Honda in north Carolina. Which I have about wrecked three times I hit a mail box and trash can because brakes suddenly gave out. Then it works a while then suddenly breaks don’t work. All they said is they’d pray for me and if I report it they won’t fix it. They say because it’s not a new law there’s no lemon law and I couldn’t pursue it. I thought I was getting a dependable car now I have to resick putting my baby in this car and hoping our life isn’t gonna end every day.April wease

    Just came across this and relieved to learn I’m not only one dealing with many brake replacements etc. I have 2008 EX and even now still have brake system issues far beyond just brakes. I saved my brakes in boxes because it was so unlike anything i have ever seen owning a car. Glad i did. I’m trying to find out how do we contact the law firm representing this Class Action? Name of firm, etc? Thanks.

    2012 civic coupe with 60 000kms/37 000 miles. Back brakes are grinding…getting my first brake job tomorrow :(
    I used to have a 2000 civic si and owned the car for 4 years and never had any brake issues! It’s too bad they don’t make some parts like they like then used to.

    I have a 2007 Honda Civic and I am currently replacing the brakes for the third time but it is the FIFTH set of breaks that have been on the car since it was made-this includes the original set and the set put on when the car was two years old and I stupidly bought it. My current bill is $530. I turned in the paperwork for the class action suit and I hope something comes out of it. This is a horrible situation for all of us. I haven’t even looked into the airbag situation yet…too busy replacing brakes.

    2010 Honda Civic LX I’m on my 2nd set of brake pads, less than 50,000 miles. This is the 5th Honda that I have owned. The dealership tried to tell me it was my driving habits. Really???the guy saying this has been on this earth for less time than I have been driving. My voice got a bit louder at the service center and the original job they quoted went from around $800.00 to $300.00. I contacted Honda’s corporate headquarters, a lot of phone tag with different folks over a period of several weeks and they offered me a Honda credit at the dealership only. My greatest concern was never answered by Honda or the dealership. There is absolutely no warning with an indicator or with noise such as squealing brakes that there is anything wrong. I did ask the dealership if I was going have to replace around every 20k and how would I know. They said that when I bring it in for an oil change they would keep an eye out for it. Duh. Why would I now keep going to them when they are also part of the cover up…Very frustrated and feeling very unsafe.
