SuperCare Health Data Breach Class Action Overview:

SuperCare Health was negligent with its patients’ private medical data, leading to a breach that exposed patient information to potential cybercriminals, a new class action lawsuit alleges.
Plaintiff Vickey Angulo filed the class action lawsuit against SuperCare Health, Inc. (SCH) Apr. 12 in a California federal court, alleging violations of state and federal consumer laws.
Angulo says that on Mar. 25, 2022, SCH posted a notice announcing publicly that an unauthorized actor accessed its files.
According to SCH’s notice, current and former patients’ names, addresses, dates of birth, hospital, medical record numbers, health insurance information, treatment information and some Social Security numbers and driver’s license numbers were compromised by an unauthorized third party in the cybersecurity incident.
Angulo alleges the data breach was a “direct result” of SCH’s failure to implement adequate and reasonable cybersecurity procedures and protocols “despite the fact that data breach attacks against medical systems and healthcare providers are at an all-time high.”
She says thousands of people’s medical records were accessed in the breach.
SuperCare Health Data Breach Class Action Claims No Compensation Offered to Patients
Angulo says, despite professing to take the privacy and security of its patients’ confidential and health information seriously, SCH had not offered to provide affected individuals with adequate credit monitoring service or compensation for the breach.
She said the breach has forced her and others to spend time protecting themselves from fraud and identity theft.
She’s seeking to represent everyone whose personal information was accessed during the data breach.
Angulo is asking a court to grant remedies including damages, reimbursement of out-of-pocket costs and injunctive relief, including improvements to SCH’s data security systems, future annual audits and adequate credit monitoring services.
She’s suing for violation of the confidentiality of medical information act, unfair competition law, breach of contract and negligence.
Meanwhile, CaptureRx has agreed to pay $4.75 million to resolve claims it failed to protect consumer data during a 2021 data breach.
The settlement benefits a nationwide class of consumers who were notified by CaptureRx that they were affected by the February 2021 data breach.
