Update:

  • Plaintiff Adiyiah Brown refuted Airbnb’s attempt to force arbitration in a lawsuit over her son’s death, stating she never used an account she created four years previously as either a guest or host on the website.
  • Airbnb attempted to force arbitration based upon an online user agreement signed on the account, but Brown says the account is unrelated to her son’s death or the Airbnb rental where Jaiden Brown was shot and killed April 17, 2022.
  • The plaintiff also claims she did not click and select a box to agree to the terms; they were simply linked to in the account creation process.
  • Jaiden Brown was one of two people shot and killed at the party at a Pittsburgh Airbnb that night, leading to Adiyiah Brown’s wrongful-death claim.
  • In March, Airbnb told a Pennsylvania state judge that a separate lawsuit over the party, filed by Tyriale Neal, who sustained injuries during the shooting, should also be arbitrated.

A woman whose femur was shattered when she was shot outside a “boisterous” party at an Airbnb rental sued the company and the property owner for her injuries, saying the party could have been prevented. 

Tyriale Neal filed the lawsuit against Airbnb Inc. and 900 North Group LLC on July 26, 2022, in the Court of Common Pleas of Allegheny County, Pennsylvania, alleging negligence. 

According to the lawsuit, an unnamed renter only known to Airbnb rented part of a duplex at 900 Madison Ave. in Pittsburgh for April 16-17, 2022. Neal alleges the renter secured the property for the sole purpose of hosting a party and advertised that party on social media.

On the night of the party, the property was so crowded that people stood outside in line waiting their turn to enter the house, the lawsuit states. By 11 p.m. the downstairs tenants in the home left to stay in a hotel because the party had become so “loud, boisterous and crowded.” 

By 12:30 a.m., about 200 people were at the party, and at least one person began shooting a gun inside the house, the lawsuit states. Neal says she fled outside but was hit by a bullet in her right leg, shattering her femur and dislocating her hip, which later resulted in scarring, nerve damage and psychological harm. Two minors were killed, and nine people were injured, according to the lawsuit.

Property owner, Airbnb negligent, lawsuit alleges

Neal claims the property owners were aware of the party and did nothing to stop it, which is against Airbnb’s “anti-party” rules.

She also claims Airbnb was negligent because there were steps it could have taken to prevent parties, including limiting two-night bookings to renters who have a history of good reviews, banning people from renting for only one night and not allowing local bookings.

Neal seeks an unknown amount of compensation for injuries, losses and damages.

Unfortunately, Airbnb faces another lawsuit that involves a death. In March, the parents of a 19-month-old girl who died after coming into contact with fentanyl at an Airbnb vacation rental filed a wrongful death lawsuit against the company, the home’s previous guest and the home’s owner and property manager.
