The parents of a 19-month-old girl who died after coming into contact with fentanyl at an Airbnb vacation rental have filed a wrongful death lawsuit against the company, the home’s previous guest, and the home’s owner and property manager.
The parents of Enora Lavenir, who died after apparently coming into contact with fentanyl at an Airbnb vacation rental in the village of Wellington, Florida, claim the house had not been properly cleaned and that they were misled that the property would be safe, Law360 reports.
In addition to Airbnb, the lawsuit reportedly names the vacation rental home’s previous guest, Aaron Kornhauser; property owner Ronald M. Cortamilia; and its property manager, Yulia A. Timpy.
Lavenir’s parents argue Cortamilia and Timpy are responsible for their baby’s death by allegedly failing to both properly clean and inspect the vacation rental and conduct adequate background checks on their guests.
Kornhauser is accused of throwing a party at the vacation rental prior to the Lavenir’s stay that involved the use of drugs and that left fentanyl and cocaine residue in the home, Law360 reports.
Airbnb vacation rental property had a secret history of being used as a party house, suit says
The property was reportedly rented by Kornhauser off the vacation rental platform Vrbo, according to the complaint, however the company has not been named as a defendant in the Airbnb lawsuit.
Lavenir’s parents claim the vacation rental house had a history of being used for parties, despite the Airbnb listing allegedly stating that the property was not allowed to host parties, Law360 reports.
Plaintiffs are reportedly making claims of wrongful death and vicarious liability and requesting an award of an unspecified amount of monetary damages to compensate them for their pain and suffering.
Airbnb agreed last month to pay $6 million to resolve claims the company charged illegal services fees on properties in Canada.
