Allstate ‘Spoofing’ Consumers on Do Not Call List, Alleges Class Action Lawsuit

An Ohio consumer says that Allstate Insurance Company uses fake phone numbers, a practice called “spoofing,” to send telemarketing messages to those on the Do Not Call List, in a class action lawsuit filed Thursday.  

Lead plaintiff, Morgan Carpenter, wants to represent consumers nationwide who she says were called by Allstate telemarketers despite registering their numbers on the Do Not Call List – a violation of the Telephone Consumer Protection Act (TCPA). Further, Allstate allegedly hired a marketing company that used “spoof” telephone numbers, or phone numbers that appear to come from the recipient’s home area code on the caller ID in an attempt to trick them into picking up the telemarketing call.  

Carpenter also claims that Allstate used prerecorded messages and automated dialing software to make the calls and failed to get the prior, express permission of consumers before calling them – all alleged violations of the TCPA.  

Carpenter says that she has had her phone number listed on the National Do Not Call Registry since at least 2015. Part of the TCPA, the Do Not Call Registry allows consumers to list phone numbers at which they do not want to be called by telemarketers.  

Carpenter alleges that despite listing her number, Allstate, through the marketing company AGAX, called her several times in 2019 and 2020. The plaintiff says she hung up on the first few calls, but decided to give the telemarketer a fictitious name to figure out who was calling her. Carpenter says that she was able to determine that the calls were a marketing effort for Allstate, which used several telemarketing companies to pepper her and other consumers with unwanted, spoofed calls.  

The class action lawsuit accuses Allstate of violating the TCPA which, in addition to the Do Not Call Registry, limits telemarketing activity. Indeed, the penalty for violating the federal law can be steep, including fines of between $500 and $1,500 per illegal telemarketing call.  

Carpenter seeks to represent consumers nationwide who were subjected to the spoofed telemarketing calls made on behalf of Allstate. In addition to enforcing statutory fines against Allstate, the class action asks for a court order stopping the allegedly illegal marketing calls.
