annoyed woman on phoneA new plaintiff alleges that she has become the victim of harassing and illegal ADT robocalls.

Her ADT robocall lawsuit accuses the company of trying to collect on a debt using an autodialing system that caused her to receive numerous phone calls.

Shawndra F. accuses the company of violating the Telephone Consumer Protection Act (TCPA).

The ADT robocall lawsuit alleges that the ADT Corporation, a security company, robocalled the plaintiff more than 100 times.

Robocalls are another term used to describe when a company uses an automated telephone dialing system or a prerecorded message to contact consumers.

Although these calls are popular among businesses because of the high volume of calls that can be made, this also makes them annoying and disruptive to consumers on the other end of the line who want them to stop.

The TCPA protects consumers from being targeted by robocalls, yet some companies are still accused of using this practice to harass consumers. However, consumers are reporting harassing robocalls even almost 30 years after the passage of the Telephone Consumer Protection Act in 1991.

In 2017, more than 4.5 million complaints were made with the Federal Communications Commission and the Federal Trade Commission over disruptive robocalls.

The ADT lawsuit alleges that the company has a corporate policy to robocall prospective customers thousands of times. The plaintiff also alleges that the company also violated the Florida Consumer Collection Practices Act by contacting her phone number more than 100 times.

The lawsuit claims that robocalls are very inexpensive to make, meaning that consumers can be contacted many different times and to the point that these calls become harassing and disruptive.

The plaintiff points out that the Telephone Consumer Protection Act was originally enacted to block companies from making illegal robocalls and invading the privacy of American consumers.

In July 2018, according to the ADT robocall lawsuit, the plaintiff began receiving calls from the defendant regarding an alleged security system debt. The plaintiff informed the defendant at that time that she was no longer able to pay for the service and asked for the phone calls to stop.

The plaintiff says that she repeatedly told the debt collector that contacted her that she revoked her express consent to be contacted. The defendant’s representatives on the phone allegedly informed her that the phone calls would not discontinue until they spoke with the plaintiff’s father.

The lawsuit alleges that an automated telephone dialing system frequently connected with robocalls was used to contact the plaintiff over 100 times in conjunction with the alleged debt and that this violated the consumer’s privacy as well as the TCPA.

The ADT Robocall Lawsuit is Case No. 8:18-cv-03051-MSS-AEP, in the U.S. District Court for the Middle District of Florida, Tampa Division.
