The government of Ontario has agreed to a proposed $2 million settlement in a class action lawsuit alleging harm to those admitted to the Child and Parent Resource Institute in London, Ontario, over several decades.

Under the terms of the settlement, Class Members could be eligible for up to $30,000 in compensation.

A class action lawsuit claims Child and Parent Resource Institute inpatients suffered harm and injury, including physical and sexual assault, at the hands of their peers, according to a Yahoo Finance report. In addition, the province is accused of failing to supervise the facility and failed to ensure those who were admitted would be safe.

The Class was certified in December 2016 and is defined as anyone who was alive as of Feb. 22, 2014, and was an inpatient of and resided at the Child and Parent Resource Institute during the period from Sept. 1, 1963, to July 1, 2011, exclusive of any time for which they were an inpatient and resided at the Glenhurst or Pratten 1 units.

If the settlement is approved, each Class Member will receive a proportional amount of the settlement fund after attorneys’ fees and other expenses are paid,

The compensation plan laid out in the settlement agreement includes payments of up to $15,000 for physical assaults resulting in hospitalization, broken bones, or other serious injury.

The settlement agreement also provides payments ranging between maximums of $3,500 to $30,000 for survivors of sexual assault at the Child and Parent Resource Institute, depending on the severity of the assault.

In addition, Class Members who are required to provide supporting documentation from a doctor, counsellor, social worker, therapist, or psychologist with their claim may be entitled to up to $500 for any fees charged related to that documentation.

Details on the claims process will be outlined in a notice to Class Members if the settlement is approved.
