Momentum Solar Do Not Call List Class Action Lawsuit Overview:

Momentum Solar broke the law by calling individuals on the National Do Not Call List without their consent, a new class action lawsuit alleges.
Lead plaintiff George Moore claims the company’s use of a telemarketing campaign to market its goods and services violated the Telephone Consumer Protection Act of 1991 (TCPA). Moore wants to represent a nationwide Class of consumers who received similar calls from the company on phone numbers they put on the do not call list.
Moore says he never sought out information about Momentum Solar before he received “several calls” from the company – despite his number being registered on the National Do Not Call List – attempting to sell him on the idea of investing in its goods and services.
Consumers are able to register their phone numbers on the National Do Not Call Registry to indicate they do not want to receive any telephone solicitations. “A listing on the Registry ‘must be honored indefinitely, or until the registration is cancelled by the consumer or the telephone number is removed by the database administrator’,” states the class action lawsuit.
The TCPA, meanwhile, regulates the telemarketing industry and is a recognition by Congress that unrestricted telemarketing is intrusive and an invasion of privacy, according to the class action lawsuit.
The Federal Communications Commission (FCC) is required by the TCPA to “initiate a rulemaking proceeding concerning the need to protect residential telephone subscribers’ privacy rights to avoid receiving telephone solicitations to which they object,” according to the class action lawsuit.
Nuisance Momentum Solar Calls Violate Do Not Call List
Moore alleges his privacy was violated by the Momentum Solar, that he was subjected to annoying and harassing calls that constituted a nuisance, had his phone line tied up, and was not provided with his express written consent that the calls could be placed.
The plaintiff is demanding a jury trial and seeking injunctive relief and treble damages of up to $1,500 for himself and all Class Members.
A similar class action lawsuit was filed earlier this month against Grand Caribbean Cruises alleging it violated the TCPA by sending pre-recorded messages to customers without their consent.

I just starting getting calls from them yesterday. I have not picked up the phone. So far I have six calls in less than 24 hours.
Daily harassing calls.
I also got call everyday. I’ve blocked their numbers only for them to generate a new number to continue calling. They also call using the name “Energy Services”.
My number has been on the national “Do Not Call List”.
How do I get in on this lawsuit?
Me too! How do I get in on this lawsuit? I just answered and tried repeatedly for 5-10min asking for myself to be taken off of the list. The guy on the phone wouldn’t confirm he took me off the list, so I tried getting him to say his spiel to confirm I get off the list, but he wanted all sorts of information from me like who my energy company is, how much I spend on energy every month, etc.
I wouldn’t give any of the information and then he went silent. Just the worst!

How do I join the Class Action Lawsuit?
I get multiple phone called the day I blocked that number and they have another number they must have hundreds of numbers so annoying I wish it would stop and I am on the Do Not Call list also
They will not stop calling! All day long! I even told the lady on the phone to stop calling and put me on the do not call list. Next endless calls all day. I block the number and they just call back on a different one.
So annoying, it is such a waste of money to call people repeatedly who have repeatedly told you they are not interested.
This company does not make business sense. Piss people off, waste money on payroll, and get sued. Smh

I would like in on the lawsuit as well! Momentum Solar harasses my phone every single day, several times a day. I have been on the national do not call registry for over 10yrs! So sick of them! I’m in Texas

Momentum Solar calls me several times a day, every day. My number is on the do not call list. I have reported them several times. So sick of them breaking the law. Bunch of freaking criminals
Momentum Solar has been calling me for 2 years or more. I block the number but they use different numbers. I’m on the national do not call list. I’m so tired of being harassed by them.
