Haironex hair growth capsules manufacturer Nutrition Research Institute, LLC consciously sells products based on fraud, a new class action lawsuit alleges.

The Haironex class action lawsuit was filed in New Jersey on August 10 by lead Plaintiff Harold Hoffman who alleges that Nutrition Research Institute uses “bogus, fabricated customer endorsements, photo-shopped before-and-after photographic depictions,” as well as false expert reviews to sell its Haironex product.

Haironex is marketed and sold in capsule form as a legitimate, efficacious hair growth product, purportedly consisting of “ancient Chinese ingredients,” vitamins and herbal supplements, the claim states.

“But, in fact, Haironex is nothing of the sort,” the Haironex class action lawsuit reads.

“Indeed, it is sold based upon bogus, fabricated customer endorsements, photo-shopped before-and-after photographic depictions, as well as the ‘expert’ review of a purportedly independent rating entity which, in fact, turns out to operate out of the identical address and with the identical telephone number as Defendant.”

Hoffman alleges that Nutrition Research Institute operates various websites, including the website Expert Rated Reviews, where it makes and publishes claims and promises with respect to independent, expert review of the efficacy of Haironex that are “unsubstantiated, bogus, materially false, illegal and in contravention of law.”

“Indeed, Defendant apparently markets and sells myriad products based upon explicitly false claims,” he alleges.

He says in the Haironex class action lawsuit that the company’s claims were calculated and designed falsely to lead consumers to believe that Haironex was an independently evaluated, effective therapy for hair loss that induces hair regrowth. Hoffman also states that the manufacturer misrepresented a material fact with knowledge of its falsity.

“In marketing and selling Haironex to the U.S. consumer public, Defendant violates explicit FDA laws, rules, regulations and guidelines, as well as the New Jersey Consumer Fraud Act,” the claim reads.

Hoffman adds that consumers, prior to purchasing the product, saw, read, heard and relied on the company’s promises, including website claims, as well as purportedly independent, expert reviews, analysis and representations, and bought the capsules because of that.

“Defendant’s advertisements, promises and representations concerning Haironex result in consumers who purchased it, being subjected to misrepresentation, false promise, fraud, deceit, trickery and false and deceptive advertising fraudulently to induce product purchase,” Hoffman states in the Haironex lawsuit.

He wants to represent anyone in New Jersey who purchased Haironex. He is suing for violations of state consumer fraud laws and seeks treble damages together with pre-judgment and post-judgment interest, fees, costs, attorney’s fees, and a jury trial.
