FloSports agreed to a $2.625 million class action lawsuit settlement to resolve claims that it violated the federal Video Privacy Protection Act (VPPA) by using Facebook pixel tracking on its websites.
The settlement benefits Facebook users who subscribed or signed up for FloSports services and viewed videos on the FloSports website between Sept. 13, 2020, and Aug. 23, 2023.
According to the class action lawsuit, FloSports unlawfully disclosed subscribers’ personal information by using Facebook pixel tracking on its website, linking user activity with their Facebook accounts. Plaintiffs in the case claim that this tracking violates the VPPA.
FloSports is a live sports event streaming website that allows users to watch motorsports, wrestling, hockey, track and field and more.
FloSports hasn’t admitted any wrongdoing but agreed to a $2.625 million settlement to resolve the VPPA class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund.Â
Exact payments will vary depending on the number of claims filed and the amount deducted from the settlement for fees and costs. No payment estimates are available at this time.
In addition to funding the settlement, FloSports agreed to suspend its use of Facebook pixel tracking on its websites until the company obtains VPPA-compliant consent. Should the Supreme Court or the 1st Circuit Court of Appeals invalidate the decision that allows VPPA to be applied to pixel tracking, the company would also be allowed to resume Facebook pixel tracking.
The deadline for exclusion and objection is Jan. 12, 2024.
The final approval hearing for the settlement is scheduled for March 1, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by Feb. 12, 2024.
