Ackercamps.com agreed to a $2.9 million settlement to resolve claims that it violated Illinois privacy laws by collecting biometrics from consumer photos on Bunk1 without their consent.
The settlement benefits Illinois residents whose facial geometry and/or biometric information were captured, used or otherwise obtained by Ackercamps.com between Aug. 29, 2017, and Oct. 13, 2023.
Plaintiffs in the class action lawsuit claim that Ackercamps.com collected biometric data from photos on its Bunk1 platform. According to the class action lawsuit, this conduct violated the Illinois Biometric Information Privacy Act (BIPA) because they never gave Ackercamps.com permission to collect their biometric facial scans.
Ackercamps.com is the company behind Bunk1, an online gallery of camper photos that includes facial geometry tagging.
Ackercamps.com hasn’t admitted any wrongdoing but agreed to a $2.9 million settlement to resolve the BIPA class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Exact payment amounts will vary depending on the number of participating class members. No payment estimates are available at this time.
The deadline for exclusion and objection is Dec. 22, 2023.
The final approval hearing for the settlement is scheduled for Jan. 24, 2024.
To receive a settlement payment, class members must submit a valid claim form by Dec. 22, 2023.
