TransUnion data breach class action lawsuit overview:
- Who: Theresa Bryant filed a class action lawsuit against Trans Union LLC.
- Why: Bryant claims TransUnion failed to protect the personally identifiable information of its customers from being exposed in a data breach that it disclosed earlier this month.
- Where: The class action lawsuit was filed in Illinois federal court.
TransUnion failed to safeguard the personally identifiable information (PII) entrusted to it during a data breach disclosed earlier this month that affected around 200 million of its U.S. customers, a new class action lawsuit alleges.
Plaintiff Theresa Bryant claims TransUnion bore responsibility for the data breach due to its “reliance on an insecure information storage and transfer system that proved readily penetrable to nefarious hackers.”
Bryant argues TransUnion “owed a duty” to its customers to “maintain reasonable and adequate security measures to secure, protect, and safeguard the PII it collected and stored about them.”
“Defendant breached said duty by failing to implement and maintain reasonable security procedures and practices to protect the PII from unauthorized access,” states the TransUnion class action.
TransUnion disclosed data breach to customers earlier this month
TransUnion disclosed the data breach — that it said exposed names, Social Security numbers, full driver’s license numbers, and financial account numbers—to its customers earlier this month.
Bryant claims TransUnion unnecessarily used, stored, and retained its customers personal information on the company’s “inadequately protected software.”
“Defendant knew that the sensitive consumer information uploaded to its proprietary database was susceptible to security risks,” states the TransUnion class action.
Bryant wants to represent a nationwide class and California subclass of individuals who had their PII exposed during the TransUnion data breach.
TransUnion is accused of unjust enrichment, negligence, and negligence per se, and of violating the Fair Credit Reporting Act and California’s Unfair Competition Law and Consumers Legal Remedies Act.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, statutory, and/or punitive damages for herself and all class members.
