T-mobile data breach settlement overview: 

  • Who: T-Mobile will pay $350 million and boost its data security thanks to a new legal settlement

T-Mobile has agreed to a $350 million settlement to resolve claims it exposed more than 76 million Americans’ personal information in a 2021 data breach. 

The proposed settlement was filed July 22 in a Missouri federal court. According to court documents, the settlement would provide monetary reimbursement of up to $25,000 for out-of-pocket losses resulting from the data breach. 

It would also compensate data breach victims for their time spent addressing losses resulting from the data breach at $25 per hour, and provide two-year subscription services to identify theft protection services. 

T-Mobile has also agreed to spend at least $150 million for data security and related technology for 2022 and 2023 to improve its network and data security and address vulnerabilities that resulted in the data breach, the company said. 

“Considering the substantial and meaningful cash and non-monetary benefits conferred upon Settlement Class Members, valued at well over $500 million, and the significant risks faced through continued litigation, the terms of the Settlement are ‘fair, reasonable, and adequate’ in accordance with Federal Rule of Civil Procedure,” a memo in support of the motion for preliminary approval states.

Millions of customers’ data compromised

The settlement comes after T-Mobile was hit with a lawsuit alleging that, sometime in 2021, one or more cybercriminals exploited T-Mobile’s data security protocols and gained access to internal servers containing the personally identifiable information of millions of current, former and prospective T-Mobile customers. 

“After exfiltrating a purported 106 GB of this data, the hacker or hackers offered to sell a subset of the stolen PII via a dark-web forum,” the memo states. 

In November 2021, T-Mobile revealed in a U.S. Securities and Exchange Commission filing that its investigation had identified about 76.6 million people whose “names, dates of birth and, in many cases, addresses” were compromised.

During the weeks and months following the breach, the plaintiffs allege they and other class members suffered identity theft and fraud. 

Under the deal, attorneys could also seek up to 30% of the $350 million settlement fund, or $105 million.

T-Mobile has been the target of class action litigation in the past.

A class action lawsuit filed in June alleges the April 2020 merger between T-Mobile and Sprint was an anticompetitive acquisition and collectively cost U.S. small businesses and AT&T and Verizon subscribers billions of dollars. 

Another recent class action against T-Mobile alleges the company launched a 5G network without telling customers it planned to shut down older networks, and didn’t address network incompatibilities for certain phones.

    My name, address, date of birth and social security number are still being found by Identity monitors from the Aug and Dec 2021 T-Mobile data breaches. How do I find out about and available compensation for that? Just yesterday, 1/2/2024, I was notified by not 1, but 3 credit monitors that my SSN was found on the dark web for to the 2021 T-Mobile breach.

    add me please I contact t-mobile over and over got no response on data breach I found out from credit Karma app from Jan 2021 open the account three.days later up until now over 350 times my personal information was found on dark web identity stolen from t-mobile data breach

    Kroll (the settlement administrator) is incompetent. I messaged them to make sure my details are removed, and that my unique ID is no longer valid. What do they do? They gave me a second unique ID. Those of you that are OK with class actions, can contact them and get a dozen unique ID’s, and file multiple claims. I am not, so I will not be using these, except maybe to file fake claims using fake info.

    You can contact the law firm and tell them that they can pay you not to dispute the settlement, or they can just contact Kroll and have your name removed.

    This has been a constant struggle with cell phone company it’s time someone takes matters to resolve this and I should be added onto the list around with this cell phone companies for the last five years empty promises setting up new towers try some different cell phones service to know help with my lousy poor service

    Hello, my entire LIVE savings was taken from me through digital wallets and Phone compromised from End auf thru November 2021. Over $70,000 dollars was used on repeat on my credit cards with chase Bank and in matter of month Chase Bank was paid over $28k to my chase sapphire and over $20k paid to my Chase Freedom Plus my Chase checking had fraud. Chase acknowledged fraud . Even agreed to over $8k due to me from checking fraud, and the over $60k in credit card fraud same vendors hit all my cards BUT chase won’t acknowledge the red flagged payments to them on prior statements when the bank got paid with all my life savings. I was left nothing but continued medical flare ups from my chronic pain condition. I have been fighting for my money to be returned by Chase due to this breach with numerous emails to all executives I could find online. No response. Sent their fraud recovery and Jose Crespo manager who I dealt with directly face to face that faxed police reports and told me face to face he believed me as he faxed proof after proof to fraud recovery. I also sat in his office when fraud recovery told him reimbursement of over $8 to checking fraud I never saw my money they shut me down. Then all the non authorized payments of my life savings due to fraud to same vendors they acknowledged and cleared cards as fraud but won’t reimburse my over $60,000 paid to them in previous statement due to same fraud charges.
    I have nothing left. My entire savings was cleaned out. Please help me.

    Sent fraud recovery emails nonstop for months. I have had to step back as my health was getting severe my panic attacks. The frustration because chase new I was hacked. They knew digital wallets all hacked and all my credit cards breached ONLY my bank of almost 30 years won’t reimburse my money back. I been fighting. Please I am begging for help. They took all my money paid out their cards in matter of month and other cards have same fraudulent charges and over another $20k and they won’t remove fraud due to breach.

      You know it had nothing to do with the data breach and everything to do with social media. Just type your name or phone number into Google. I bet your address and all your info is out there for free. Funny how mine is not.
