Stanley Steemer data breach class action lawsuit overview:

  • Who: Julia Kaled filed a class action lawsuit against Stanley Steemer International Inc.
  • Why: Kaled claims Stanley Steemer failed to protect its current and former customers’ personally identifiable information during a data breach disclosed by the company earlier this month.
  • Where: The class action lawsuit was filed in Ohio federal court.

Stanley Steemer failed to properly safeguard and secure its current and former customers’ sensitive information during a data breach that occurred earlier this year and was disclosed earlier this month, a new class action lawsuit alleges.

Plaintiff Julia Kaled claims Stanley Steemer had a legal and equitable duty to protect personally identifiable information (PII) that had been entrusted to it by its customers from “unauthorized access and intrusion.”

“Defendant failed to adequately protect Plaintiff’s and Class Members PII — and failed to even encrypt or redact this highly sensitive information,” the class action states.

The plaintiff wants to represent a nationwide class of consumers who had their PII affected and/or acquired by an unauthorized third party as a result of the data breach disclosed by Stanley Steemer on or about Nov. 15.

Breach allegedly caused by failure to implement ‘adequate and reasonable’ security measures

Information exposed during the Stanley Steemer data breach included names, Social Security numbers, driver’s license numbers and financial account information, according to the class action.

The plaintiff argues the data breach was due to Stanley Steemer “intentionally, willfully, recklessly, or negligently failing to implement and maintain adequate and reasonable measures and ensure those measures were followed.”

“As a result, the PII of Plaintiff and Class Members was compromised through disclosure to an unknown and unauthorized third party,” the Stanley Steemer class action states.

The plaintiff claims Stanley Steemer is guilty of negligence, breach of implied contract, breach of fiduciary duty, unjust enrichment and breach of confidence.

She is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, statutory and punitive damages for herself and all class members.

A consumer filed a separate class action lawsuit against Stanley Steemer in September, arguing the company failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired.
