Mr. Cooper lawsuit overview:

  • Who: Mr. Cooper is facing a class action lawsuit after a data breach that impacted 14.6 million customers’ personal information.
  • Why: Mr. Cooper did not do enough to protect customers’ data and is therefore responsible for allowing that data to be nefariously accessed, the Mr. Cooper lawsuit claims.
  • Where: The Mr. Cooper lawsuit was filed in federal court in Dallas, Texas.

Mr. Cooper is facing a class action lawsuit claiming that it did not provide the proper protection to avoid a data breach that impacted 14.6 million customers’ personal information.

It is the second class action lawsuit accusing the mortgage corporation of not doing enough to protect the personally identifiable information (PII) of its customers in another recent class action lawsuit.

The data breach involved customers’ names, addresses, phone numbers, Social Security numbers, dates of birth and bank account numbers being accessed.

“Defendants claim that ‘[k]eeping financial information is one of [their] most important responsibilities[,]’ and ‘customer service, trust and confidence is a high priority,’ the new Mr. Cooper lawsuit says. “Despite these outward assurances, Defendants failed to adequately safeguard plaintiff’s and class members’ highly sensitive private information that it collected and maintained.”

Data thieves have information to wreak havoc on Mr. Cooper customers

Enough information was stolen that the data thieves could fraudulently open new financial accounts, take out loans, obtain medical services, gain government benefits or file fraudulent tax returns, the new Mr. Cooper lawsuit claims.

Even the class members who have not yet been subjected to identity theft are at an “an immediate and heightened risk of all manners of identity theft,” the Mr. Cooper lawsuit claims.

The class has claimed Mr. Cooper is guilty of negligence, breach of implied contract, was unjustly enriched and breached its fiduciary duty.

The Mr. Cooper class action lawsuit is Garrigo v. Nationstar Mortgage LLC d/b/a Mr. Cooper, et al., Case No. 3:23-cv-02842-L, in the U.S. District Court for the Northern District of Texas Dallas Division.
