San Juan Regional Medical Center Data Breach Class Action Lawsuit Overview: 

  • Who: Jeremy Henderson filed a class action lawsuit against San Juan Regional Medical Center.

San Juan Regional Medical Center was negligent in allowing a 2020 data breach to expose the personal information of its patients, a new class action lawsuit alleges. 

Plaintiff Jeremy Henderson claims the hospital allowed the sensitive health information and other private data of 68,792 patients to be revealed, the Farmington Daily Times reports

The hospital, on the contrary, has stated that more than 500 individuals were affected by the breach.

Henderson claims he received a letter dated in September from the hospital informing him that his information had been compromised in a data breach from a year prior, the Farmington Daily Times reports. 

The hospital acknowledged in its letter that an unauthorized individual had gained access to its network and removed private patient information, Henderson says in the class action. 

Henderson claims the data taken included names, birthdates, addresses, phone numbers, email addresses, Social Security numbers, drivers license numbers, financial account numbers, passport numbers and health insurance and medical information, the Farmington Daily Times reports. 

Patients who had their personal information accessed are now at risk of suffering from identity theft and fraud, Henderson argues. 

Henderson further claims affected patients must now closely monitor their personal and medical information to ensure it isn’t used in a fraudulent manner, the Farmington Daily Times reports. 

Hospital’s Offer Of Fraud Monitoring Not Enough To Compensate Victims, Plaintiffs Say

The hospital has reportedly offered affected patients up to 12 months of fraud monitoring; however, Henderson claims this is not enough compensation for the damages incurred and the time spent self-monitoring. 

Henderson claims he has received an uptick in scam calls and text messages since the data breach, the Farmington Daily Times reports. The hospital, meanwhile, has previously said it has no evidence that any of the information that was taken in the data breach has been used in foul play.. 

Henderson claims the hospital’s failure to implement proper safeguard to protect its patients private data violated the Health Insurance Portability and Accountability Act, reports the HIPAA Journal

Kroger reached a $5 million settlement agreement earlier this month to resolve claims related to a December 2020 data breach that exposed the private information of its money services and pharmacy customers and current and former employees

    I have received a letter of my information in this data breach. Someone tried to buy a car in my name in Alabama. And too many phone calls from across the country telling me I won this and that. I want to be apart of this lawsuit.

    I have not received anything from San Juan regional medical center. I have charges on my credit card intact I received a bill from a fitness center and I never been a gym or anything like that. I had to change my credit card out but now my new card is get scammed I have been wondering why my card and information is been leaking out I have to say .I get calls on some stupid stuff like I was deported out of the United States and lost all my disability payments had to prove I was a an American citizen had my a regional birth certificate from San Juan regional hospital it been a mess and now I know why. I what San Juan regional hospital to pay big time they been getting awy with too much I been around this crooked hospital for 53 years let’s get them boss .

    I have received a “breach of information” letter on myself and on my husband from SJRMC. Since the breach I have had a credit card compromised.

    I as well recieved a letter dated June 04,2021 notifying me that the files accessed contained some of my personal information Specifically my DOB,SSN,Medical diagnosis/treatment information :MEdical record number,patient account number.. I called on the 9th of june at 5:28 p.m the guy working that line ended up having my letter read to him stating what was taken from my file …was just wondering if someone could contact me as well …

    Myself and my dad both received the letter that our information was part of the breached information. The hospital has done nothing to compensate us, not even a offer for a protective services.

    I have not received anything from San Juan hospital concerning a breach. How can I find out more on how to join this suit? want to file a suit as they have put in my medical history a complete fabrication of how I broke my hand and also that I called an ambulance because u had Covid. Also one of the nurses mistreated me leaving bruuses. Doctor wasn’t much better. Can I sue this hospital?
