R.R. Donnelley data breach class action overview:
- Who: A woman sued R.R. Donnelley for a 2021 data breach.
- Why: The plaintiff says the company was negligent with protecting people’s data, including dates of birth and Social Security numbers.
- Where: The R.R. Donnelley class action lawsuit was filed in an Illinois federal court.
R.R. Donnelley suffered a data breach that affected hundreds, if not thousands, of people’s personal information and then did not warn them their data had been stolen until almost nine months later, a new class action lawsuit alleges.
Plaintiff Robin Forslund filed the data breach class action lawsuit against R.R. Donnelley & Sons Co. Aug. 12 in an Illinois federal court, alleging negligence and breach of privacy.
On Dec. 23, 2021, R.R. Donnelley identified a systems intrusion into its network, Forslund says. It implemented a series of containment measures to address the situation and commenced a forensic investigation. Upon investigation, the company found outside actors first accessed Defendant’s systems on Nov. 29, 2021, the R. R. Donnelley class action states.
“Despite learning of the Data Breach in December 2021, Defendant did not begin notifying Plaintiff and Class Members until on or around August 5, 2022,” Forslund alleges.
As a result of the R.R. Donnelley data breach, the exposed information can and likely will be sold on the dark web, the class action claims.
“Plaintiff and Class Members now face a lifetime risk of identity theft, which is heightened here by the loss of Social Security numbers — the gold standard for identity thieves,” according to the lawsuit.
R.R. Donnelley class action alleges company negligent in its data storage
The private information was compromised due to R.R. Donnelley’s “negligent and careless acts and omissions,” the class action states.
Forslund seeks to represent anyone in the United States whose data may have been accessed during the R.R. Donnelley data breach and estimates the class could number into the thousands.
She sued for negligence, breach of contract and invasion of privacy. She also seeks certification of the class action, damages, fees, costs and a jury trial, as well as improved data protection protocols.
In related news, the United States is the most expensive place in the world to recover from a data breach with an average cost in the millions, according to a July report released by global digital identity company ForgeRock.
Meanwhile, attempting to hold companies accountable for their data security practices has become a frequent reason for recent class action lawsuits and, in a number of cases, subsequent class action settlements. Check out some recent examples here.
