Class action claims 106 million consumers exposed in 2019 Capital One data breach

A nationwide class action lawsuit has been filed in Virginia federal court over a 2019 Capital One data breach that allegedly exposed the personal information of more than 106 million individuals in the United States and Canada.  

Lead plaintiffs Brandi Edmondson, Brandon Hausauer, Sara Sharp, and Gary Ziekicke say that the Capital One data breach, which was announced on July 29, 2019, exposed the personal and financial information of small businesses and individuals who applied for credit card products between 2005 and 2019.  

Stolen information allegedly included Social Security Numbers, bank accounts, credit scores, and other financial information, along with names, addresses, phone numbers, birth dates, and email addresses. The plaintiffs claim that all personal information remain “dangerously exposed” to hackers.  

In addition to Capital One, the plaintiffs also name Amazon and its subsidiaries as defendants responsible for the exposure. A rogue Amazon employee exposed sensitive personal customer information for months, alleges the class action. The plaintiffs say that Amazon’s bad data protection policies failed to detect or stop the hack that now affects hundreds of millions of everyday consumers.  

Neither Capital One nor Amazon detected the data breach, regarded as one of the largest incidents of data theft, for months despite the fact that the rogue employee publically posted about their hacking accomplishment on social media sites, claims the class action lawsuit.  

“Moreover, Capital One—which has almost limitless resources to protect the vulnerable data entrusted to it and in the face of well-publicized data breaches sustained by numerous other companies, including financial institutions in the United States—was fully aware of the perils of a data breach and its legal responsibility to protect against a data breach,” reads the complaint.  

This is not the first class action lawsuit to be filed over the Capital One data breach. Shortly after the breach was announced, a lawsuit was filed in New York federal court. In addition, several class actions have been filed in Canada over the hack.  

The plaintiffs in the most recently lodged lawsuit seek to represent a nationwide Class of consumers whose personal and financial information were exposed in the breach. The plaintiffs also seek to represent residents in their respective states, including Texas, Washington, California, and Florida. 

In addition to damages, the class action is seeking a litany of actions from Capital One and Amazon to further protect the data they collect from a future hack.

    Please add me …..Had to be issued new card because of suspicious activity. I hadn’t charged anything so i was wondering how anyone could have gotten my information. Yes, now that data breach would be a way.. Why didn’t Capital One just say there was a breach…Also happened with my visa card and had to be reissued. I went to pay my bill and found they (Visa)closed my acct and didn’t inform me . Now my credit report is crazy with unknown accts. Went to finance a used car and was shock at the interest rate , capital One was going to charge me 24.7% This is what made me go to my credit report and that was only Experia, didn’t check trans or the other FICO credit as I am scared. I cannot get falase address in my report to be taken off and frustrating with all the stuff i am going to have to say to these companies I just been turned down from. Tried to refinance—No ( and I have lots equity)tried to sell mhy home and buy another….did not have credit good enough. I was at like 720 and suddenly plummeted to 540….Yeah! Add Me Please Me

    Why isn’t there a link to be added to this settlement?
    I noticed other commenters saying “Add me” but I don’t think that is going to be very effective, is it?
    There should be a link to fill out all the appropriate info & the one about “joining a data breach lawsuit” seems unrelated to this particular suit.

    How would I know if my personal information has been compromised. I have been recently receiving more harassing phone calls from people claiming to be from my Amazon, my bank and capital one accounts.

    I’ve never had a problem with Capital One all of these years. I was looking at a few comments, I noticed one in particular. How would I know if I’ve been breached? I shop on Amazon pretty frequently. I have my cards on Auto Pay and, to be truthful I don’t even look at the charges. I’ve been unwise.

      I have to say something weird is going on with Amazon and Capital One. I’ve tried buying some things as I am trying to check out, I get a message saying ” either use another form of payment, or call your institution. That’s new.

    My husband has charge’s on his capital one card that he did not make which made him go over his credit limit. I was an authorized user on this account. Eventually the account was closed but they did not remove the charged. This has affected both of our credit and has limited our ability to purchase things we applied for. Car loan, other credit. Please add me
