Comcast Robocalls Class Action Lawsuit Overview:

  • Who: Comcast is facing a class action lawsuit for allegedly robocalling noncustomers.
  • Why: Channel Aweau alleges the company called her repeatedly since Oct. 2020 despite her not having an account and telling the company to stop.
  • Where: The case is pending in Philadelphia.

Comcast illegally robocalls to noncustomers invading their privacy, even after it has been told to stop, a new class action lawsuit alleges.

Lead plaintiff Channel Aweau alleges in the lawsuit that since Oct. 2020, the telecommunications giant has repeatedly sent her robocalls about an account that does not belong to her, violating the Telephone Consumer Protection Act (TCPA).

She is suing on behalf of anyone in the US who has received a robocall from the company in the last four years, and seeks $500 for each call and $1,500 for each call made knowingly in violation of the TCPA.

In the claim, Aweau says she is not, and has never been, a Comcast customer and did not provide any consent to receive calls from the company.

“On numerous occasions, Ms. Aweau informed Comcast that it was calling the wrong number and asked Comcast to stop calling her,” the claim alleges. “Comcast stated that it marked her number as ‘do-not-call’ and promised Ms. Aweau that the calls would stop.”

Despite this, Aweau says Comcast nevertheless continued to call her.

Comcast Aware of Robocall Problem, Claims Class Action Lawsuit

The plaintiff alleges that Comcast is aware of the problems with its system resulting in the improper calls, adding that the company has been sued multiple times for the same thing.

She says Comcast caused harm to her and other people it sent robocalls to, including lost time tending to and responding to the unsolicited calls, invasion of privacy and nuisance.

Comcast is also fighting off claims from customers that it fails to tell consumers how long it will maintain their personally identifiable information.

The plaintiff is represented by Max S. Morgan and Eric H. Weitz of The Weitz Firm, LLC.

The Comcast Robocall Class Action Lawsuit is Aweau v. Comcast Corporation, Case No. 211100417, in the Philadelphia County Court of Common Pleas Civil Trial Division.

  1. Thomas C. Adams says:

I too get robocalls daily or sometimes multiple robocalls calls in a day to my home landline telling me that Xfinity has a special promotion that can save me up to $600 over Verizon. I have never had a Comcast account. When I pick up a call, and press the response number and ask the human who answers to take me off their list, they hang up on me. When I call the number that they supposedly called me on, it says not in service.

  2. Richard Moyare says:

We too get almost daily, unwanted, unsolicited calls from Comcast. Speaking to a live person by pressing one and telling them to STOP, did absolutely no good. The irony is that we have been advised in the past that our house is too far off the road and if we actually wanted Comcast/Xfinity, it would cost about $1500 to dig a channel for the fiberoptic line.

  3. Mark R Powell says:

Daily Comcast robo calls. I block number, but in comes another call on a different number. I would never consider using Comcast after this crap.

  4. Heather says:

It has been 5 years since I have been a Comcast customer. I have started getting multiple robocalls regarding comcast every week. It is extremely annoying and I have verified I am on the do not call list.

  5. Jolene says:

I have repeatedly received calls from Comcast/Xfinity. I have never been a customer. I have asked them to stop but I am still receiving calls. It’s super annoying.

  6. Krystal B. says:

    04/25/23
I am not a Comcast/Xfinity customer at all.
I just received an unauthorized prerecorded sales call from this company
I ha e told them in the past STOP calling on our other landlines and cell phone bit now doing it again
Enough is Enough of this nonsense. These companies don’t create and don’t stop when told too.

  7. Joyce E Cormier says:

I get numerous calls that come up as individual names. When I answer it is a recording from Comcast. I have told them to stop calling me, but the calls keep coming.

  8. Roni Elayne Singer says:

I have NEVER been a Comcast customer, yet they call my landline at least 5 times a week! The Caller ID has various names such as Neiman Marcus, Amazon, and the worst being MD Anderson Cancer Hospital because at the time I got this robo call my son-in-law was actually in MD Anderson undergoing blood cancer treatment!! This must stop.
