Forman Mills agreed to pay over $2.38 million to settle a class action lawsuit claiming it violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting employee biometrics without providing the proper disclosures.

The class action lawsuit settlement benefits Forman Mills employees who had their biometric information (fingerprints, hand scans, etc.) collected at a Forman Mills location in Illinois between May 5, 2015, and Sept. 1, 2020. There are around 3,435 individuals included under this definition. 

The biometric class action lawsuit claims that Forman Mills violated BIPA by failing to implement the proper consent forms and disclosures required by the law. Forman Mills employees say their BIPA rights were violated when their fingerprints and hand scans were collected for timekeeping purposes. 

Forman Mills is a chain of warehouse-style stores with locations around the country, including in Illinois. 

Forman Mills hasn’t admitted any wrongdoing but agreed to a $2.38 million settlement to resolve the BIPA class action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. 

Each class member is estimated to receive around $400. Exact payments will vary depending on the number of participating class members.

The deadline for exclusion and objection is July 10, 2023.

The final approval hearing for the settlement is scheduled for Aug. 22, 2023.

No claim form is required to benefit from this settlement. Class members who do not exclude themselves will automatically receive a payment. Class members can update their addresses on the settlement website to ensure their payments are sent to the correct addresses.
