Forman Mills agreed to pay over $2.38 million to settle a class action lawsuit claiming it violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting employee biometrics without providing the proper disclosures.
The class action lawsuit settlement benefits Forman Mills employees who had their biometric information (fingerprints, hand scans, etc.) collected at a Forman Mills location in Illinois between May 5, 2015, and Sept. 1, 2020. There are around 3,435 individuals included under this definition.Â
The biometric class action lawsuit claims that Forman Mills violated BIPA by failing to implement the proper consent forms and disclosures required by the law. Forman Mills employees say their BIPA rights were violated when their fingerprints and hand scans were collected for timekeeping purposes.Â
Forman Mills is a chain of warehouse-style stores with locations around the country, including in Illinois.Â
Forman Mills hasn’t admitted any wrongdoing but agreed to a $2.38 million settlement to resolve the BIPA class action lawsuit.
