Sincera Reproductive Medicine agreed to a $1.2 million class action lawsuit settlement to resolve claims it failed to prevent a 2020 data breach.
The settlement benefits individuals who received a notice from Sincera Reproductive Medicine informing them their information was involved in a data breach that occurred between Aug. 10, 2020, and Sept. 13, 2020.
In May 2021, Sincera revealed its clients’ information may have been compromised in the 2020 data breach. According to a class action lawsuit against the healthcare company, Sincera failed to take reasonable action to prevent a data breach.
Sincera Reproductive Medicine, previously known as Abington Reproductive Medicine, is a fertility clinic with four locations in Pennsylvania.
Sincera hasn’t admitted any wrongdoing but agreed to a $1.2 million settlement to resolve the data breach class action lawsuit.Â
Under the terms of the settlement, class members can receive a $150 payment if they suffered harm associated with the data breach such as lost time, loss of confidences, loss of personal information and emotional distress.
Class members who sustained financial damages as a result of the data breach can receive up to $2,000 in reimbursement — including the $150 payment available to all class members.Â
In order to receive reimbursement, class members must provide documentation of out-of-pocket expenses and affirm under penalty of perjury that these losses are a result of the data breach.Â
The deadline for exclusion and objection is June 23, 2023.
The final approval hearing for the Sincera Reproductive Medicine class action lawsuit settlement is scheduled for Sept. 6, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by July 24, 2023.
