Biomat, Talecris Plasma Resources and Interstate Blood Bank, all part of Grifols, agreed to a $16.75 million class action lawsuit settlement to resolve claims they violated the Illinois Biometric Information Privacy Act (BIPA) by scanning fingerprints without first getting consent.

The class action lawsuit settlement benefits individuals who scanned their fingers on a finger scanning device during the plasma donation process at either a Biomat USA or Talecris Plasma Resources center in Illinois between June 10, 2015, and June 10, 2022.

The settlement also benefits individuals who scanned their fingers on a finger scanning device during the plasma donation process at the Interstate Blood Bank plasma donation center in Illinois between April 8, 2016, and July 25, 2022.

Plaintiffs in the class action lawsuit say the plasma donation centers failed to get their consent before using technology that scanned their fingers. According to the class action, the donation centers violated BIPA.

Biomat, Talecris Plasma and Interstate Blood Bank are plasma donation centers. All three of these centers involved in the class action lawsuit are part of Grifols, a network of plasma donation centers around the country.

The plasma defendants haven’t admitted any wrongdoing but agreed to a $16.75 million class action settlement to resolve the BIPA allegations.

Under the terms of the BIPA settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary based on the number of claims filed. 

According to the settlement website, a 55% participation rate would result in payments of around $300 per claimant. A 30% participation would result in $550 payments, while a 15% participation rate would result in payments of around $1,100.

The defendants also agreed to comply with BIPA requirements in the future, including obtaining written consent from plasma donors.

The deadline for exclusion and objection is May 22, 2023.

The final approval hearing for the settlement is scheduled for Aug. 24, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Aug. 4, 2023.

    I got a check. My question is, would depositing it void any future litigation? I was harassed during many transitions at the location I donated plasma. The app that was used to check me in failed for months. A security guard looked at their computer one day and discovered it was an error unique to my account. The next week, my app would not work to check me for an unknown reason.
    In addition, they changed the brand of machines used to draw our blood three times in one year. The last machines had a date of 2012 on them.

      From what I read if you filed a claim you can’t file a litigation in the future, it says the only way you could have done that was by May 2023 to send a letter to the court to be opted out. You can call them to be sure I read it first but there’s information explaining that part on their website. If you don’t cash it you just lose it and have no further legal claims against the company. Hope that helps. Still waiting for my check!

      If you didn’t file a claim with the ID and pin number they won’t let you now, I have a friend who donated at the same times I did and she never received any email nor anything in the mail but gave them proof she did indeed donate during the specific times and they still excluded her, doesn’t make sense, she never moved or changed email addresses and we went together each time yet I received the claim number and pin in the mail and she didn’t. Now they say the settlement is closed so they wouldn’t add her anyways, doesn’t make sense!

        If they would simply do an update everyone wouldn’t be so confused, it’s not that hard to update. Ive read some people have gotten theirs. I opted for a check. If I don’t get it next week I’m going to call instead of getting a generic email response!

          Sent my claims form online in May. They say, didn’t get it. What can one do. They had to receive it

            I’m so sorry to hear that! I got mine in the mail but it online and I screenshot the form I filled out so I would have proof. It seems this has been a very shady deal. Alot of people who should have qualified and showed proof were excluded! When I was emailing and asking about it they also told me they didn’t have my name in the database and I luckily had the screenshot of the form I sent them and then all of a sudden they found me. I’m sorry that happened to you!
