Indeck Power agreed to pay over $66,000 as part of a settlement to resolve a class action lawsuit claiming it violated the Illinois Biometric Information Privacy Act (BIPA) by collecting worker biometrics without consent.

The settlement benefits current and former Indeck Power workers, including employees, temporary workers and contractors, who had their biometric identifiers collected without first signing a written consent form between Feb. 19, 2016, and March 10, 2023.

BIPA requires companies to get written consent from consumers and workers in Illinois before collecting their biometric identifiers such as fingerprints. Indeck Power allegedly failed to get the required consent before collecting the biometrics of its workers.

Indeck Power Equipment Co. is a supplier of boilers, generators and power equipment parts.

Indeck Power hasn’t admitted any wrongdoing but agreed to a $66,825 class action settlement to resolve the BIPA allegations.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating class members, but class counsel anticipates each class member will receive around $471.

The deadline for exclusion and objection is May 15, 2023.

The final approval hearing for the Indeck BIPA class action lawsuit settlement is scheduled for July 27, 2023.

No claim form is required to benefit from the settlement. Class members can update their address by July 27, 2023, to ensure they receive their payment to the correct location.
