Vaginal Mesh Implant Lawsuits Could Reach 10,000
By Andrea Gressman
A report by MDND, Mesh Medical Device News Desk, has indicated that the number of vaginal mesh implant lawsuits that have been filed against six manufacturers of vaginal mesh synthetics is in the thousands, as noted by court records located in West Virginia, New Jersey, and Georgia. Not only that, but there is expectation that the number may double. The vaginal mesh implant lawsuits were filed by women suffering from severe, debilitating life-changing injuries they claim were caused by defective bladder sling implant and transvaginal mesh implant devices made by the defendants. West Virginia’s Southern District’s court records indicated nearly 2,000 filed a vaginal mesh implant lawsuits against Ethicon and American Medical Systems each, while there have been reports of 1,000 vaginal mesh lawsuits each filed against C.R. Bard and Boston Scientific. Georgia, California, Massachusetts, Delaware, and New Jersey are locations in which state vaginal mesh lawsuits have been filed.
It is the belief of some vaginal mesh lawsuit attorneys that the total number today could surpass the 11,000 mark and even double, which will rival the product liability litigation of Vioxx — a huge multi-billion dollar litigation.
Even though the number of vaginal mesh lawsuit and Vioxx lawsuits are both high, the similarities end there. If you take Vioxx, Celebrex, or Avandia and you have a bad reaction — for example, a heart attack — you will most likely not have any more adverse reactions once you stop taking the medication. With vaginal mesh side effects, however, that is just not the case.
Vaginal mesh implant lawsuits have been filed by victims who spent years, even a decade, suffering from vaginal mesh side effects and injuries. In a deposition in the transvaginal mesh implant litigation, a doctor commented that the future concerning these products is indeterminable. There is no way to tell if every implant will erode in the period of a decade.
It is predicted that the side effect rate for vaginal mesh implants is at a 29% high, especially for the Ethicon Prolift vaginal mesh, manufactured by Johnson & Johnson, which is now in the process of being phased out of the market.
However, there are differences in each state’s Statute of Limitation laws, and a woman may no longer be eligible to file a vaginal mesh lawsuit before her first symptoms occur. This is advantageous to manufacturers of the vaginal mesh implant.
A vaginal mesh implant victim spoke to MDND and expressed her disbelief that a minor problem can have such a huge impact on life, that it may alter it irrevocably. She indicated that her life as she knew it no longer exits.
