Mother Files Birth Defect Lawsuit Over Son’s Zoloft PPHN

Zoloft PPHN lawsuitThe mother of a child who was born with Zoloft PPHN has filed a birth defect lawsuit against drug manufacturer Pfizer, alleging she was never warned that taking Zoloft during pregnancy would put her unborn child at risk of harm. Her Zoloft birth defect lawsuit alleges that Pfizer was aware the risk of harm to developing fetuses, but concealed this information from the public. She is seeking punitive and compensatory damages for her son’s injuries.

Plaintiff Lauri Serrano alleges in the Zoloft birth defect lawsuit, filed August 1, 2012 in the U.S. District Court for the Eastern District of Pennsylvania, that her son was born with birth defects caused by her use of Zoloft during pregnancy. Serrano’s son was born on November 12, 2005 with persistent hypertension of the newborn (PPHN), a birth defect that causes breath and lung function problems immediately after birth. Zoloft has been linked to PPHN in numerous lawsuits over the years.
According to Serrano’s Zoloft lawyer, Pfizer was aware that taking selective serotonin reuptake inhibitor (SSRI) drugs like Zoloft during pregnancy could increase the risk of birth defects, but failed to warn the public. Under U.S. law, drug manufacturers are responsible for disclosing all known side effects on drug labels. Since Pfizer was allegedly aware of published studies linking SSRI antidepressants to birth defects, the company had a responsibility to communicate this information to the public and place an adequate warning on the label. Pfizer did not comply with this duty, and is therefore liable for counts of negligence, breach of warranty, failure to warn, design defect, fraudulent misrepresentation and concealment and unjust enrichment, Serrano’s Zoloft birth defect lawsuit alleges. Serrano is seeking punitive damages and compensatory damages for her son’s past and future medical expenses, pain and suffering, mental anguish, and more.
