Lax FDA Leads to New Stryker Metal Hip Implant Lawsuit
By John Curran
The federal Food and Drug Administration wants to get helpful drugs and medical devices onto the market and that means allowing companies to use older studies get approval for similar products. Unfortunately, in the case of two Stryker metal hip implants, the first round of studies were wrong, and Erma Neagle suffered as a result.
Neagle has filed a Stryker hip implant lawsuit against the manufacturer alleging their metal-on-metal hip implants caused her severe injury and side effects. The two hip implants she received are the Stryker Rejuvenate and the ABG II. Neagle’s right hip joint was causing her problems and she received the Stryker Rejuvenate metal hip implant in 2010. Problems persisted, and she never quite recovered from the procedure. In fact, around the same time that Stryker was issuing a recall over the summer, Neagle had to undergo two separate revision surgeries to fix the metal hip implant failure.
First, the damage simply had to be repaired, with a block of antibiotics and excision of the damaged tissue due to ground-up metal remaining inside her body. Then, another hip replacement system was implanted without the attending Stryker metal hip implant side effects. Thanks to increased awareness of problems with these joint replacements, Neagle filed a hip implant lawsuit against the company soon after.
The FDA has been beset by problems relating to its accelerated approval process for similar devices and drugs. On the one hand, it does bring updated products to the healthcare sector more quickly. Unfortunately, given the agency’s reticence to issue warnings with any real speed, even given studies it helps fund, the risk of problems like metal hip implant failures is going to continue.
Similar problems occur with medications, where the agency ignores reports of side effects and injuries without immediately forcing drug makers to warn consumers. In the case of Stryker metal hip implant side effects, however, it not only causes pain and suffering, but limits the mobility of aging Americans even more than their conditions prior to the surgery.
