Hip Replacement Complications Focus of New Lawsuit Against Stryker

By Jessica Tyner

Stryker hip replacement complicationsMarlene Maloney filed a lawsuit against Stryker Corporation on Sept. 5, 2013 after she allegedly suffered serious complications from their hip implant. The Illinois resident opted for Stryker’s Rejuvenate system, which was supposed to be devoid of the side effects of traditional metal on metal hip implants. According to the hip replacement lawsuit, however, the Stryker Rejuvenate has been linked to thousands of reports of injuries allegedly caused by the device releasing metal ions into the blood stream.

“In April of 2012, Defendants issued an Urgent Field Safety Notice to surgeons and hospitals in the United States regarding the Rejuvenate. In this Urgent Field Safety Notice, Defendants acknowledged that it had received reports of device failure due to heavy metal contamination. The Urgent Field Safety Notice specifically referred to failures at the taper neck junction between the neck and stem due to corrosion and fretting,” the Stryker hip lawsuit says.
When Maloney underwent right total hip replacement surgery on March 22, 2012, she thought that she was given a safe device. However, she began to suffer complications from the Stryker hip implant, according to her lawsuit.

“Subsequent to implantation of the Rejuvenate hip, Plaintiff began experiencing significant pain and stiffness. In October of 2012, Plaintiff underwent a diagnostic workup which revealed high levels of metal ions including a significantly high level of cobalt. Plaintiff’s physician also found a large fluid collection in her right hip with pseudotumor formation,” the hip replacement lawsuit says. “Plaintiff was diagnosed with mechanically assisted crevice corrosion with severe adverse local soft tissue reaction. As a result of the evaluation, Plaintiff underwent revision surgery to remove the defective Rejuvenate implants on January 10, 2013.”

According to Maloney’s hip implant lawsuit: “As a direct and proximate result of Defendants placing the Rejuvenate into the stream of commerce, Plaintiff has suffered, and continues to suffer, both injuries and damages including, but not limited to, past, present and future physical and mental pain and suffering; and past, present and future medical, hospital, rehabilitative and pharmaceutical expenses; economic loss, and other related damages.”

She is seeking actual damages, past and future treatment cost compensation, damages for pain and suffering, damages for mental and emotional anguish, and punitive damages. She’s also asking for cost of suit, interest, attorney’s fees, and any other relief the court sees as appropriate.

The hip implant lawsuit is Marlene Maloney v. Stryker Corporation, MDL No. 13-2441, in the United States District Court for the Central District of Illinois.
