GranuFlo Lawsuit Says Husband’s Death Caused by Dialysis Complications

GranuFlo Recall LawsuitClementine Hamilton of Mississippi is suing Fresenius USA Inc. for the wrongful death of her husband Michael Hamilton who allegedly died after using NaturaLyte and GranuFlo during dialysis treatment.

The GranuFlo lawsuit stated that Michael received dialysis treatment that included the use of GranuFlo and/or NaturaLyte. After using both dialysis products, “decedent suffered an adverse cardiovascular event and died on July 18, 2007.”

The GranuFlo lawsuit further contends that the decedent was not aware of the risks of serious injury and/or death associated with or caused by the use of GranuFlo and NaturaLyte.

Even the individual healthcare providers involved in the treatment of the decedent were not aware of the risks of using GranuFlo and NaturaLyte, the lawsuit said.

The decedent would not have purchased and used both dialysis products had he been properly informed of the risks of serious injury, including death, from using both drugs, the GranuFlo lawsuit said.

Fresenius USA is the largest division of Fresenius Medical Care AG in Germany. It is also the largest provider of dialysis services and products worldwide, operating most dialysis centers in the United States. It even supplies its products to its competitors, including DaVita, DCI, Renal Ventures, and others.

An internal memorandum from Fresenius on November 4, 2011 indicated that Fresenius had knowledge that there was a significant increased risk of cardiac arrest and death during hemodialysis treatments associated with its two dialysis products. Unfortunately, the knowledge about these GranuFlo and NaturaLyte risks came too late for Michael Hamilton.

“Having knowledge of the significant increased risk of cardiac arrest and death during dialysis treatments associated with GranuFlo and NaturaLyte, Fresenius executives and officers chose not to properly report the problem to the Food and Drug Administration, other governmental agencies, or the public,” the GranuFlo lawsuit said.

Plaintiff Clementine Hamilton is seeking for actual damages in an amount not less than 1 million dollars and another 1 million dollars for punitive damages.

The Fresenius wrongful death lawsuit is Clementine Hamilton v. Fresenius USA Inc., Case No. 1:13-cv-12360-DPW, in the Circuit Court of Adams County, Mississippi.
