First Court Hearing Takes Place in Biomet Hip Implant Lawsuit MDL
By Andrea Gressman
The first court hearing involving the Biomet metal hip implant lawsuits has finally started. The initial hearing concerning the Biomet Magnum, which is a metal on metal hip implant commonly used by the company, began last Friday. This is the fifth MDL to take place regarding metal hip implants. Metal hip implants that have come under fire have included Zimmer Durom Cup, the Wright Converse Hip, the DePuy ASR, and the DePuy Pinnacle.
Among all of the hip implants that have currently faced coordinated litigation, only the DePuy ASR as well as the Smith & Nephew R3 were recalled. This is surprising considering the number of metal hip implant failures patients have faced. The number of failures has reached an exceptionally high level, which should be considered unacceptable by any standards. During the American Association of Orthopedic Surgeons meeting of 2012, it was agreed by popular consensus that they should no longer use metal hips because of the high failure rates.
Despite the fact that even doctors have expressed their dissatisfaction with the product, many metal hip implants continued to be used. Fortunately, there seems to be commitment involved in getting the metal on metal hip implant lawsuits moving in order to handle all the plaintiff requests on a reasonable basis. Currently, Biomet Magnum faces several similarities to other metal hip implant lawsuits that are pending in other districts. Many of the individuals who have had metal hip implants have experienced the implants failing or breaking on them, only to find themselves undergoing yet another hip implant surgery as well as other painful side effects.
When these metal replacement hip implants fail, it can cause permanent and irreversible damages to the tissue and muscle surrounding the hip. The pain experienced by the plaintiffs is described as excruciating.
Some of the side effects linked to faulty replacement hip implants include:
* Death of tissue around the joint
* Loss of surrounding bone
* Pain
* Swelling
* Bone damage
* Bone loss
* Metallosis
* Premature hip implant failure
* Pseudotumors
Currently, there are nearly a hundred Biomet lawsuits that are pending in federal courts. Hip implant lawyers in attendance are waiting to hear from around four hundred more hip implant lawsuits at the very least that either have or will be filed. The hip implant lawyers have stated that they are expecting there will be approximately one thousand or more metal hip implant lawsuits filed against Biomet Magnum and M2a. In comparison to other metal hip implant lawsuits, there are more than six thousand pending with the DePuy ASR MDL.
If you or someone you know has suffered metal on metal hip implant failure, talk to a legal professional regarding your options. It is entirely possible that you may be eligible for compensation for any damages and injuries you incurred from the metal hip implant.
